Wrong date on GC ad applying for N400

Hello everybody, I am not sure if I am posting in the right place.

 

I filed for ROC and was approved, I received my GC but it has the wrong "resident since" date on it. It is off by 10 days. I entered the country on the 17th but the date says the 7th.

I am planning to file N400 as if I entered on the 17th and not the 7th.

Will this typo be a problem during N400? Will it cause my petition to be denied for any reason? Should I go through the hassle of filing I-90 and wait like 8 months for this to be fixed? I also don't want to give away y GC and wait forever to get a new one.

 

Please let me know if someone went through this.

What I would do in your position would be to file your N-400 as if the card said the 17th, as you intend to, to ensure that your N-400 won't be immediately bounced by someone who isn't paying attention. I would then file an I-90 on the basis of a USCIS error, meaning there would be no fee.

 

You can file both of these applications online.

If I did this, won't I need to mail in my GC? What if I have to go N400 and I don't have my GC with me? Will that be a problem?

You mail a PHOTOCOPY of the GC with the N400, not the card itself.

By the time your N400 interview rolls around, you'll have the new card in hand.

I mean when you file I-90 online, don't you have to mail the actual GC with typo back to them? I am worried if I do that, then I go to USCIS interview and they ask me about my GC, I wont have it with me.

Yes you do.

You will likely receive your new corrected green card back by the time the N400 interview happens (you haven't even filed the N400 yet so you have plenty of time still before an actual interview date).  If you don't have it by then, you can also bring the i-797 NOA from the i-90 showing you've filed for a replacement card as evidence why you don't have the physical card in your possession.

Frankly, I wouldn't file the I-90, given that you have to surrender the green card and the processing delays. It's not worth the trouble, especially if you need to travel before your N400/I-90 is adjudicated. Just make sure you file the N400 after your true anniversary date, and put that date on your application.

I had the same issue.

1- I filed online for N400 and I90 in december 2017.

2- in September they sent me an RFE requesting my greencard.

3- 2 weeks after I sent them my greencard, they sent me a new greencard with the right date.

 

....

4- I'm still waiting for my N400 interview. (it was supposed to be Dec 21 but was cancelled)

 

I would advise you to file for I90 online. Even if it is stressful to not have your greencard, it would be for only a couple of weeks and not months.
