Weird, anyway only person who can answer that is the Lawyer.

The NOIR was issued 21 months ago.   It is over.

It is clear that the wife has delayed responding, let alone responding, finding an attorney, filing taxes as married, and doesn't seem interested in filing again. Both the wife and husband have made mistakes throughout the process. The beneficiary doesn't understand that he didn't file DCF and has even asked about doing a F2a. He has complained about the cost to get an attorney to fix their mistakes.  With Skype, Facebook Messenger, Facetime and now even Zoom, he should have been able to be involved in the attorney meetings. He seems quite eager to get here; his wife isn't putting in the effort. Now they are waiting for CBP.  Nothing makes any sense in this case which leads me to believe either there are facts not being shared here or it's one big troll.

Not sure we can help until the wife clarifies what is going on.

My wife forward me the emails and she said attorney will call the uscis soon we will findout if the attorney is going to take our case or not and she will also tell us which is the best way for our case I was just wondering if I didn't visited usa then why CBP check on me I think CBP check is usually for those people who came on visit and then after that when they apply for other different kind of visa and they check if someone don't overstay in the United States I am just confused about it

@Sparrow, when is the last time your wife visited you?

Seems like you have been away from VJ for a long time.  I have wondered how your case is going.

We are doing the process all over again we have to fix those allegations before applying so they don't deny our case again we are finding where we made mistakes and the attorney said it's going to take 4 to 6 months so now it's been 7 months and my wife call the attorney and the attorney said she is only waiting for the last check which is CBP that's really confusing why they are waiting for that and wasting our time if she know that I never been to States before this is only month we are waiting for their response and after that we will hire the another attorney who got  knowledge in complex cases and I just want to be with my wife and I will update everyone when I hear something from attorney

Sparrow, could your wife join this conversation? She's the one who met/discussed with the lawyer, she might be able to explain better what is being done exactly.

Not the first time members asked the OP to have his wife join and provide details. He either chooses not to have her join or ask or she chooses not to get the help they need.

Attorney said she is going to take our case but she will charge 4500 $ so once we save up the money then we start the process

After 5 years and a NOIR......you're still at this?

If you really want to have a life together, why hasn't she moved to your country?
