Requirements on K3 co-spnosors

I have a couple of questions concerning the K3 Visa.

I have two kids. One of them doesn’t live with me. However, I do pay his mom monthly support. This is not the same as legal child support, because legal child support deals with the state and is usually for dead beat dads. I never had an issue of not paying to support my kid.

However, I didn’t claim the son that doesn’t live with me as a dependent on my income tax. Do I have to claim him as a dependent on my K3?

I am a student at Georgia Tech. Would USCIS take issue with me being a student? I currently work part time and dont meet the Poverty Guidelines, however the money I have saved in the bank and plus my income meets the Poverty Guidelines.

My parents are willing to be my co-sponsors. However, they just recently moved to Georgia and they haven’t found full time work yet. My dad is working part time job as an electrical engineer. His part time income, like me, plus the money he has saved is enough to care for 6 people according to the Poverty Guidelines.

Does USCIS take into consideration the monies you have saved and your income or is it just based on income?

No, unless the child lives with you and you are fundamentally financially responsible for him, you would not put him as a dependent.

If your annual income alone does not meet poverty standards, as you are a student, I would grab a co-sponsor to be safe.

I asked my mom to co-sponsor. It's better to err on the side of caution in all visa matters.

On your affidavit of support they ask for all sources of income, bank accounts, savings, bonds, stocks etc - but seriously, to be safe, I'd get a co-sponsor.

My parents are my co sponors. My dad is working part time now. However, his job is slow. He usually works 4 days per week, and he does make way over the required amount. However, these last couple of weeks he hasn't gone to work since his firm is slow. I was wondering if his savings would help. My mom plans on opening her business and I know she will be making more then twice the requirements. I guess what I need is a miracle. I hope by the time the papers are to be sent to the embassy, her business is established.

If she was in business for 1 month would they accept her income as stable, or does it have to be a certain time period for it to be valid to the embassy officials ?

This statement does not make sense. Do you pay child support as part of the divorce settlement? Or do you pay it out of the goodness of your heart? If it is part of the divorce settlement it is "legal child support" whether or not you've ever been a dead-beat dad and whether or not you have the right to claim the child as a dependent for tax purposes.

If you are required to make the child support payments as part of your divorce settlement then you should identify the child as a partial dependent on your I-134 affidavit of support. If you could stop making the payments tomorrow without any consequence to you then you do not need to show the boy on your I-134.

I pay child support not because of a divorce settlement. I pay freely because this is my child.

Ok, thanks you so much because I dont pay because of a divorce settlement. I feel its my duty as a parent to take care of my son.

Now concerning the income. Do they take savings, property value, Value of personal possessions as a form of finances ?
