Sponsoring parent that already resides in US with Green Card

Immigration has the option on their applications to sponsor parents who over stayed their VISA and resides in the US. If it was so illegal sponsoring my parents then why does USCIS have the option to do so??? Seriously educate yourself on the laws before you start calling things illegal

and that is why laws for Adjustment of status need to change, and who knows in trump world they just might, so I guess really good luck and hope he isn't picked up and put into deportation before that happens :)

Simply having a social security number does not grant the right to work. How is the father filling out the I-9 for his employer? If he is claiming he is a US citizen this is a major issue and could result in a life-time ban.

Thank you belinda63. He has a SSN, work authorization and a tax ID which was legally issued we just wanted him to apply to make it all more solidified. Thank you for answering me and not being snobby

Not everyone tells the truth to CBP when visiting the US. If your FIL had said he was going to visit but never going back to his home country, I imagine he wouldn't be here right now. Once you are in, intent alone does not stop one from adjusting one status.

On what basis is he legally working now????

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

LMAO its so funny how now the law needs to be changed.....but before I was breaking imaginary laws. You guys are hilarious. You dont even read anything off of the USCIS website before you start giving advice. I am glad that now you are informed that immigration offers the option to sponsor someone who has overstayed a VISA and that it is in fact NOT BREAKING THE LAW! *EYE ROLL*

But coupled with misrepresentation of any kind can be reason to deny AOS.

ONCE YOU HAVE WORK AUTHORIZATION YOU CAN LEGALLY WORK IN THIS COUNTRY. 

 

On the basis that he needs to provide for himself smarty pants....do you know how work permits work?

He came when the laws werent strict so long ago that he was able to work on a visitors visa. Thats how he has some of his documents.

Refer to my original post. I said hes here legally. Everyone else is saying hes here illegally not me. He entered legally and overstayed. So he has an I-94.

Thats what I am not sure about. Because all his documents are still valid nothing has expired other than his visa. So I was wondering if anyone else had gone through the process similar to this and whats forms we would need to fill out.
