My cr1 spouse visa interview been done last year Nov 14 2017 and I been handed white paper 221g and been advised to wait my case is under administrative process on December 27 2017 my visa status been changed under administrative to refused sending emails to embassy and been contacted embassy involved senator embassy said my visa is under administrative process and will be contacted to applicant soon after administrative process complete but waited long more thn a year of interview today I checked online visa status and it says returned to NVC idk what it means if it's bad news or good embassy never contacted with me after interview they still keeping my passport and original documents but they returned my case to nvc it gives me bad feelings my wife in usa was crying over this pls someone help me to understand if my visa is denied or they r going to issue the visa thnx alot.

-First, please updated your timeline and using semicolon and comma when posting.

-Second,  you have to contact Embassy to see what going on with your case.

-Thirst, if Embassy return the case to NVC, the case we be back at USCIS and it will took a few months.

what was the 221g for?

 

the reason for the denial is in there.

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

now your USC waits for the letter to come as to why case is returned

it will be a NOIR or NOID

one allows the USC to make a response within a time limit to argue the denial and give proof that the issues are wrong

the other says u can appeal / an appeal will take a year at least

Are you sure the 221g was just for Administrative Processing?   If not, any chance they emailed you requesting information that you did not submit?  If so it would make sense that they returned the case after one year of not getting them.   The fact that your status changed to refused a month later sounds like they needed something from you.

 

If they decided at the interview they were returning it would not have taken them a year to do so and it would have stated on the 221g it was being returned.   

 

My best educated guess is they needing documents that they didn't receive or they came across evidence during the administrative processing that caused them to refuse the visa.   

 

You're case is refused not technically denied just yet USCIS will send you information on a denial after reviewing your case.  It will go to NVC after NVC records what they need (usually about a  month or two) they will forward to USCIS.   USCIS will respond to you first after receiving it (to let you know they have the file) then again with their response to what the embassy has sent but it will take several months to a year.  Then you'll have the answers you need.   

 

Not really much you can do now but replay the interview and figure out what you may have missed.

Thnx guys for ur time and respond the shocking thing for me and for my wife is whenever we emailed embassy and senator emailed embassy behalf on my case we got respond from embassy that my case is under administrative process and they'll contact with me as soon as administrative process complete but they never contact with me they never asked any additional documents they never even contact with my wife in usa the most painful is they wasted a year in administrative process and thn they returned the case to nvc it's rediculous nonsense they played with me and my wife's feelings if this is what they decided thn why they waited for a year on 221g white form they didn't asked any additional documents but advised me to wait and now after a year it returned to NVC it's hurting my passport and original documents r still in embassy they didn't returned it to me yet I didn't received any email mail or phone call from embassy it's spouse visa me and my wife r extremely sad we never expected this to happen we don't know what to do its all about our future we love each other truly we want to live together no one can understand our feelings pls help us if there is any way
