No. A strict requirement for the I-864 is to have filed for at least the past 3 years (unless not required to do so...as in if you had no income).

A responsibility of being a USC is to file tax returns. While there likely won't be any penalty or even tax liability involved, one can only claim the FEIE and/or FTC by actually filing taxes.

You are still required, as a US citizen, to file annual taxes.  Hopefully you dont get hit with FBAR penalties.  They’re pretty harsh.

On with sending off late tax returns! Hopefully will be resolved ASAP and can get my tax return evidence for the aos. Just some final checking now. Myself spouse and 3 children. Joint sponsor and spouse no dependents. 

Children 3 - I-864W COMPLETE

Myself (sponsor) 1- I-864 (household 5, intending immigrant 1)

Joint sponsor 1-I-864 (household 3, intending immigrant 1)

JS spouse 1-i864a (household 3, intending immigrant 1)

Unsure who to list as family members on the 2 i-1864s because it says to only put family members if they are on the same visa petition, which they are not. I presume I don't put any family members. Just list 3 dependants on mine.
