Help! Family emergency following K-1

Okay guys, I’m in a situation right now and I really need some input from anyone who can offer any info!

 

I am currently in Montreal, Canada. My interview for my K-1 is on wednesday. My fiancé and I both flew and met here on this past wednesday. The same day we found out his father had a heart attack. He left on thursday to go be with his dad, while I am here waiting for the interview. I’m assuming I will get the visa as we have a very straight forward case..

 

Things are up in the air regarding his dad and we just don’t know what to do. Is it possible to fly there after I have my K-1 but not activate it? Like use the regular B1 or B2 (i forget what it is lol) visa I get when entering like I usually do. If I can prove I still have work and ties here, and that I would just be going there to be with him. (This would be if god forbid something went wrong and he lost his dad. Please keep him in your thoughts and prayers. If that’s not your thing just please send good vibes our way for a good recovery.) We are not ready for me to move there yet and with everything going on we just don’t want to have to worry about our wedding right now. I’m just wondering if anyone has any idea if this is possible or if there is anything I can do. If I can use the travel visa I would obviously bring proof that I’m returning back to canada. (Letter from work, return flight, etc). 

 

Idk you guys, I’m just a mess. I appreciate if anyone can help me out. Thank you.

This is a Canada specific question.  You might want to post this in the Canada forum.  LOTS of people from other countries will say that you cannot enter the U.S. without using your K1 visa.  Which is the truth for all other countries.  The only people I have seen be able to do this are Canadians crossing at land crossings.  But it is a case by case basis and it not a guarantee.  So please post this where you can get region specific advice.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Have be interview but explain the situation. Ask for your passport back and send it back to the embassy when things are more settled or you two came up with a plan. 

Likely there will be less time to enter the US after that because it’s 6 months after medical, but at least makes sense in your situation.

This is entirely dependent on the POE officer if you have the visa in your passport.  You can ask at interview to recieve your passport back due to family emergency and you'd like to travel right away.  You'd have to send your passport back to Montreal to have the visa placed in it so you can activate it.

Situations like this are best dealt with by calling, emailing the consulate directly, or as stated inform them of theses changes at the interview. Only they can direct you and assist without error. I'm sorry to hear about your situation and i wish your fiances dad a speedy recovery. Best wishes.

I don’t know how it works specifically for Canada, but in Colombia when they approved my K1 Visa at the interview she immediately stamped my previous visa (a tourist visa) with a red stamp that said cancelled without prejudice or something like that. She explained that because I was now a K1 holder the other one was no longer valid since you can’t hold two different visas at the same time.

Not the issue here.  Canadians can typically enter without a Visa
