Hello VJs,

I have lost contact with my spouse, since I ve decided to move back my country becouse our marriage was a nightmare. Now, she doesnt want to talk to me anymore and changed phones, address, etc. I am ( or was?) a K1 holder with AP and EAD ( bouth expired). During my 1 year stay in the USA my case was pending of aproval ( Actually in the USCIS page my case appears as still pending)

So now its impossible to contact her and I cannot go back to the USA due my AP is overdue.-

She may have divorced me.... so... How Can I get the divorce decree since I cannot enter to the USA?

Any suggestion?¿?¿ Many thanks and good luck everybody.

Could you contact the county office where you and your former spouse applied for your marriage certificate? Not sure what the regulations are for your state regarding divorce, but here in Georgia your divorce is registered in the county in which the marriage certificate was applied for. Hope this helps some.

did you know anyone in your town that could pick it up with a letter from you?? Not sure of the regulations there... but in California my husbands mom could pick up his papers but friends or whatever had to have a letter of approval from you. Sometimes there is an online thing to get your papers... but costs more money usually.

I have a friend that could pick up the divorce decree ( Actually I still dont know whats my legal situation).

Unfortunatelly this case sounds like Im going to need an attorney since I dont see how I can get permit someone (i.e. a friend) to act in behalf me

If you are divorced living in another country now; this is what I would do. I think you have done some of this already:

1. Find out what county/state you were divorced in. (if you are divorced)

2. Contact the county clerk's office and tell them your situation. Just be honest. Tell them your husband is un-coopertive, and you want to find out if he has divorced you and if he has, you need a copy of the decree.

3. Take names and phone numbers.

I fiind it hard to believe that the county will not give you a copy of the decree. Yes, you will have to pay a fee for the decree and maybe you can get it mailed to a friend's address in the USA.

The bottom line is that the county has to give you a copy. I had to get an old copy of a divorce that happened in 1982. I just called the county clerk's office and told them the date and names, gave them a credit card number for the fees, ($18.00 USD), and they mailed it to me in 3 days. No problem at all.

I would really hold off on hiring an attorney until you try this. If you have to hire an attorney, just call one and pay for a 30 minute consult. As the previous poster stated, states have different laws, but I really believe that you should be able to get a copy, after all it was your divorce.

I was able to call my county clerk, send a check and the mailed out the divorce decree. I lived in a very small county. However, this should work, and if your county is online you maybe able to pull the divorce decree online, they are public documents. I dont understand why anyone would need your permission to go to the county and get a copy of it. I have pulled other peoples divorce decrees before, no questions asked.

(it was for their mortgage application, not some weird reason)

If I understand you correctly, you don't know whether you are divorced or not. It would seem the first step is to find out and then the second step is obtain a certified copy of any divorce decree. If you are not divorced and want to be, you should be able to obtain a divorce in your home country, regardless of where you married.

The procedure for finding out about divorces and/or obtaining copies of divorce decrees varies according to State and local policies. Your wife or former wife would have filed for any divorce within her local jurisdiction. Do you know in which County and State she has lived since you marriage? If so, which County and State?

Facts are cheap...knowing how to use them is precious...

Find the US jurisdiction where the divorce may have taken place..search their data base to find out if it has/had been filed, or call the court clerk, and request a copy of it. My county in California has all the cases on line...and instructions on how to receive a certified copy.

This is NOT the way it is. Divorce does not have to occur in the country of marriage. If not claiming any property, property isn't an issue. Also the US spouse does not require any cooperation of the foreign spouse. "Service" can be done by publication. Do you think the foreigner's life is in the hands of the USC, since he can't return to the US? Is THAT the way YOU think it is?

The county is the state where they live now, has jurisdiction...period. If the OP decides to return to some country...that country would not have jurisdiction.....because they cannot get jurisdiction of the US resident, because he cannot be served here the same way that you cannot serve someone in a foreign country without them accepting service. Service by publication requires court permission in some jurisdictions after demonstrating that all other means of service have failed.

If the US resident was served by some court overseas by some means (dont know how)...he could have it quashed in his county court as it is the court of jurisdiction.

you can always ask the court if a limited power of attorney would be enough for your friend to pick up this paper.
