Hi Hanna Bui .. Does your approval letter it shows priority date for your pervious 485 or i130 Filed ?

It shows the priority day of my previous I485 and I-130 (filed the same day for both). My I-485 was denied then i filed vawa.

Yes IIo .. It's very Confusing I am sure Other peoe here they have the same problem too .. For my Knowledge priority date is the date which I 130 or pervious 485 filed it doesn't matter your spouse is LPR or USA citizen.

 I have the same situation with you. Until now i not sure what is for.

I understand the VAWA process can be overwhelming, try not to focus on things that do not matter. If your ex was a USC then priority date does not mean anything for you. ONLY if your ex was a LPR then the priority date matters.

Everyone gets a priority date- but it is only looked at for those who ex is and LPR.  For anyone who ex was a USC- the priority date that is printed is N/A- visa numbers are immediately available. For an LPR ex the priority date needs to be current based on the visa bulletin to get a GC. Priority dates are generated on all petitions but are only looked at if its for an ex of an LPR. It can be confusing to have info on your correspondence that is N/A but thats how USCIS does it and it doesnt look like they plan on changing things so people wont be as confused.

After submitting my RFE documents last month, I got an email with subject "Correspondence Was Received And USCIS Is Reviewing It"

and hopefully I will get update letter as well.

What does it mean? Is it normal update or some positive sign .

That means they got the response you sent for the RFE and are reviewing it. Its good that they got your response, now you just wait. Hang in there!

This is my story;

I filed for I-360 and I-485 concurrently and I received my Notice of Action.

I just recently received my Biometric appointment for both I-360 and I-485 (in one letter).

My abusive husband was a U.S. citizen and we applied for my GC in January 2018 (my marriage based I-485 is "ready to be scheduled for interview" however I have filed for divorce and I don't live with him anymore).

and I have EAD Card from marriage petition.

My concern is about my work permit!

My lawyer refuses to apply for new I-765 based on my VAWA petition.

She also refuses to renew my current EAD card, under my VAWA petition I-485.

She believes that I am not eligible to apply for work permit, till my I-360 gets approved.

I would appreciate your help;

What is the correct action on my EAD Card?

If I fire my lawyer, can I take care of my self-petition myself? or I have to have a lawyer?

ONE more question;

can my abusive husband deport me or cancel my marriage petition?

Sandra has posted about this before. Since you sent a new 485 your old one is done with so to speak. You are eligible to file for an EAD either based on your new 485 c09 OR with an approved VAWA c31. If your attny does not know this they are not an experienced VAWA attny and you may want to consider finding a new one. (you can not renew your old EAD because you filed a new 485 instead of asking them to hold the old 485)

Hey @sandranj can I get arrested by going to housing court

Please make sure that You have align no. (A no. with You ) and have your VAWA applied so that you can inform the ICE if they arrest you.

or you should have a valid  status.

however keep backup contacts and attorney support if you have not any of above.

Rest Sandra can guide you.

@Hanna Bui @xoxox I have the same deal, my old and denied 485 date as my priority date on Vawa approval. Abuser is USC. Maybe that’s normal for USCIS now. C31 card and approval notice have arrived. Let’s not worry about it, per Damara’s suggestion.

Can I ask you why and/or how your 485 denied? and when did you file a new one?
