If you have a copy of the 765 it will say what category you are applying under.- also you can call and ask the attnys office. Many attnys do mistakenly file for c31. Its an error on their part and sadly nothing you can do about it. USCIS does not care if you filed under c31 instead of c09. Again if it was filed under c31 you have to wait until VAWA approved which shouldnt be much longer since you filed a year ago, or you can submit another 765 under c09 now and wait up to 6 months for it.

 

IF it was filed under c09 and is still pending then there is nothing wrong with asking for a status update or using the congressman to inquire. Many people do this and it does not negatively impact the case.

When I just got married i live with him after I left but the therapist said I never live with him I ddnt see his letter so my is different so something is fishy around.they said that .and they said I never talk about the neighbors on my letter .i ddnt mention when I met him if he was citizens or lawful residence.

Today I learnt that If we pledge that if we devote our life for service of Lord and serving His Creation ( like feeding birds/animals, helping needy) then He do our work with Supersonic speed, and I Think It happened with me as I was praying hard since couple of months.🙏🙌

 

Anyone Seniors, please guide how much time it takes to get GC interview ?

I did medical initially in 2015 and got EAD via C09. Now as going through VAWA , do I need Medical again or USCIS would tell me ?

Its so nice to hear of approvals!

Now that you are approved you have to wait for your case to get sent to your local office and for them to set an interview. You can check how long your local office takes for that online. You may also get some updates as the case moves- the final one should say at local office waiting interview. Some local offices take a few months to interview, some are backlogged around a year. Hopefully yours isnt such a long wait!

 

Some times people get a reminder notice before the interview stating they need a new medical.If you get that notice then get the medical done. But do not rush to get the medical done now because it can be a long wait until interview and you dont want it expiring again. If you know your medical is expired and you get an interview appt (usually gives several weeks notice) but no notice of medical then get the medical when you know the interview is set..

Are you planning on just refiling under new spouse? Since you remarried you do not qualify  to refile VAWA, Im not sure if you can even appeal successfully since you are remarried. You should wait for Sandra to reply.

So timelines:

All biometrics were done and I was told that I can expect my I-765 within 3-6 months since applying.

I still don't even get the next steps. Very scared and tired. Frustrated. Imagine living so long without a work authorization and having a child all alone under such circumstances.

I know it is emotional. But I appreciate all advice. My lawyers don't tell me nothing and just push me away.

PS: just a thought maybe somebody knows for sure (my lawyers said there is NO discrimination about it). But my all fees were waived for all forms. Can it play a role in it?

I don’t think it has anything to do with discrimination, the issue is if your work authorization was filed under category C9 (based on pending i485) or under C31 (based on i360). The C9 takes 3-6 months to get approved and the C31 work permit you only get once your VAWA is approved.

Thank you. I'm trying to receive the answer from the lawyers and want to visit them tomorrow and get a copy of my entire case, too.

I can't trust them at all. Waiting SO long without trying to double check under what form they filed it. I did not know a things about it before I was advised here on it.

Well my lawyers did not even know there there is NO interview on the petition itself just during AOS. Face palm..:((

It’s always good to keep a copy for your own records and especially to double check everything, people make mistakes. 

I hope you didn’t pay them too much money, they seem like they don’t know what they’re doing. Maybe you should fire them and find a pro bono lawyer that can help you with your case and what’s coming after the VAWA approval!

Here is VJ sample form, your form may be different because this is the most recent version. The previous versions are not that much different. On this version you can see at the bottom of page 1 (number 16) where it says what category. If it says C09 then you are well with in your rights to ask about whats going on since its been 1 year now. 

 

Also didnt see the part about the fee waiver stuff. Using a fee waiver or paying makes NO difference to how they handle your case except for them needing to approve the fee waiver before processing - where if you sent a check they start processing immediately. Even factoring in time for the fee waiver to be approved puts you way out of normal processing times for a C09 EAD

Wow..you should have read the psychological evaluation from the therapist...how many sessions did you do with the therapist and what has your neighbor got to do with your personal statement

YEa the vawa is likely over since you have remarried...you can ask Sandra what to do if there is a way out

@Sheenane Do you have a new attny?  You most definately need one and not the same one that screwed up your VAWA.

 

Technically you are not a VAWA case anymore because it was denied and you are not appealing but rather planning on doing a new AOS through a new spouse. Your post does fit in the VAWA thread however because its about filing a new AOS after a VAWA denial. Im just not sure there is anyone else posting currently in that situation... Have you tried using the search feature? Im sure this topic has come up before and Sandra has offered advice on it.
