Thanks to going to the old pages of this forum and particularly reading all of @sandranj  advice, I felt confident enough to send back the RFE on January 10, 2019. On March 9th, 2019 I got an alert saying I GOT APPROVED FOR FORM I-360.

You used this forum and website exactly as they were intended -- research, read, study, act.  Congratulations to you, and thank you for your educational, inspirational post.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello all,

Did any of you deal with an ex using your legal status against you during child custody? My ex has a GC and my daughter is a US citizen. My ex has told the judge that since only have my EAD card which is only valid for 12-18 months at a time after which I have to renew it, I am only here "temporarily". How do judges/courts usually deal with/handle this type of situation? Can he use my immigration status against me in court? I would appreciate any information that you can share with me regarding this issue. Thank you!

@namastenyc I experienced a similar situation during my divorce/custody. My ex told the judge that my work permit was expired and I didn’t have a job and might also be deported. The judge told him that was the reason he needs to pay child and spousal support. He also said the judge should send a notice to social services not to give me food stamps should I apply and then judge said she was not social service. Long story short I ended up with full custody . Be strong. That won’t be any problem as family court doesn’t deal or want to know about immigration statuses.

Hey guys,

Got a question...my wife is pregnant from another man (most likely, not 100% sure yet). How does it affect the situation with my status because we are divorcing already soon and I am planning to apply for VAWA due to abuse in a relationship.

Thank you!

That will not have any impact in my opinion. However, just an FYI @sandranj has always said USCIS does not consider cheating to be a ground for VAWA.

I deal with custody with my ex as well, you tell the judge your immigration status has nothing to do with your child custody, you are legal at the moment and you case is pending,  and i recommend you to get a court lawyer it is free, so the process can be smoother.... my case was easy since I had an order of protection in place  at the moment of fighting for custody he did fight for to have Joint custody and he got it, and we can only have limited communication just about our children nothing else. Family court seek the best interest of the child. Good Luck and don't be afraid.

Yes I did today. Third one from January

I'm receiving this alert since I apply on June 2018. I received them Every week, sometimes twice a week. This inactivity alerts you can turn them off at your My uscis account. I think is not important.

I have been waiting since October 29 2018

to get my I485 adjucated, all silent...almost 5 months not sure why Chicago has a long wait 13 - 33 months but I read others timelines so it seems that it takes 4-8 months after I360 approval to get adjusted.

I got my I765/EAD approved on February 22 2019 from the original Application’s Packet giles on May 2017, not sure why getting to EAD’s Cards 1st one from my I360 approval on Oct 29 2018 and blew this last one. Confusing...

Anyone knows if I should renew my EAD from Vawa or just renew when time comes the I765 instead?...

Thanks in advanced.

Congratilations to all approvals 💫🇺🇸

Hello everyone! I am a long time reader but a first-time poster on this forum. I want to, first of all, thank everyone who has contributed to this because it really does help a lot of people myself included. I was deeply depressed, had no money, no lawyer or even a place to live, due to various abuses from my wife, but got encouragement from this forum via various peoples stories. I was also in removal proceedings due to overstaying a visa. However, after being greatly inspired by this wonderful forum, I gathered all the evidence I could and sent it in July 2017. After I got my receipt number I heard nothing until October 2018, when they sent me an RFE for Good Moral Character,  Termination of Prior Marriages (I was married and divorced before) and Section 204(g) (because I was removal proceedings). The GMC and Termination of prior marriages were easy but Section 204(g) was intimidating. Every lawyer I consulted told me that it was going to be next to impossible to get approved because the burden of proof is much higher when you are in removal proceedings. However, I believe only God knows my destiny, so I did not get discouraged. I started to research in this forum of how on what I could send to reply to Section 204(g) which basically wanted more evidence to prove the marriage was real. Thanks to going to the old pages of this forum and particularly reading all of @sandranj  advice, I felt confident enough to send back the RFE on January 10, 2019. On March 9th, 2019 I got an alert saying I GOT APPROVED FOR FORM I-360. I really want to thank everyone who contributed to this forum and I will pray for all of those who are waiting for their results and who are thinking about filling.

MY TIMELINE I-360

-- JUNE 30 PACKAGE SENT (TAX RETURNS, LEASE CONTRACT, RENT & UTLITIES RECEIPTS [20 MONTHS], MARRIAGE CERTIFICATE, ID'S SHOWING SAME ADDRESS, PSYCHOLOGICAL EVALUATION, JOINT BANK ACCOUNT [10 MONTHS ACTIVITY], PERSONAL STATEMENT [15 PAGES], 5 WITNESS STATEMENTS, PICTURES OF INJURIES SUFFERED)

-- JULY 7 2017 RECEIPT RECEIVED. NO PRIMA FACIE

-- OCTOBER 7 RFE: GOOD MORAL CHARACTER, TERMINATION OF PRIOR MARRIAGE, SECTION 204(g)

-- JANUARY 10 RETURNED RFE: GOOD MORAL CHARACTER (STATE BACKGROUND CHECKS), TERMINATION OF PRIOR MARRIAGE (DIVORCE DECREE), SECTION 204(g)[ BONAFIDE MARRIAGE WAIVER, JOINT BANK ACCOUNT (18 MONTHS ACTIVITY), 3 WITNESS STATEMENTS, JOINT CREDIT CARDS]

-- MARCH 9 APPROVAL NOTIFICATION

Congrats! So happy for you. Thanks for sharing your story and inspiring me with your positive and resilient attitude!

Thanks a lot, dear. I hope the judge is well-informed and questions my ex about his motives for taking advantage of my immigration status in court.
