Public charge adjudications would only account for receipt of designated public benefits, including cash assistance for income maintenance, Medicaid (with limited exceptions for Medicaid benefits paid for an “emergency medical condition,” and for certain disability services related to education), Medicare Part D Low Income Subsidy, the Supplemental Nutrition Assistance Program (SNAP, or food stamps), any benefit provided for institutionalization for long-term care at government expense, Section 8 Housing Choice Voucher Program, Section 8 Project-Based Rental Assistance, and Public Housing.  
The covered benefits generally represent the largest Federal programs for low-income people by total expenditure that address basic living needs such as income, housing, food, and medical care.  
Under the proposed rule, receipt of public benefits that are not covered by the 1999 Interim Field Guidance (i.e., Medicaid, the Medicare Part D Low Income Subsidy, SNAP, and the designated housing benefits) would not be considered for public charge purposes unless the receipt occurred after a final rule becomes effective.

@sandraj I applied for I-485, I-765, I-130 concurrently. My I-765 application has been approved and the EAD has been delivered under C09 category. Later on I had to apply for I-360 (VAWA) which is pending under prima-facie determination . I did not apply for I-765 (c33 category for VAWA)  and I-485 concurrently with I-360.  I haven't worked with the EAD c09 which was applied as a GC EAD. Now I am planning to apply for OPT-EAD ( C3B category) which is under non-immigrant F1 status . Which option should I use on the form I-765(C3B category )form now 1.a: initial permission to accept employment or 1.b: renewal of my permission accept employment? The form also asked for Alien Number or I-94 . Which one should I provide on this I-765 (OPT-EAD). And I would also be glad if I have more suggestions in this situation.

For sure! And Sen. Kirsten Gillibrand also, they inquired about my case on Friday, and got notification the same day that the inquiry about my case has been completed, then just today I got this! 😁

It means the NBC will ship your case to the local office . The local office might take 6/18 months to schedule the AOS interview.

You don't need to file form 325-A. if you want advance parole then you have to file I-131. Submit form G1145 as well. Considering that you didn't get everything right I am afraid  how you wrote your affidavit.

Hello everyone! I am a long time reader but a first-time poster on this forum. I want to, first of all, thank everyone who has contributed to this because it really does help a lot of people myself included. I was deeply depressed, had no money, no lawyer or even a place to live, due to various abuses from my wife, but got encouragement from this forum via various peoples stories. I was also in removal proceedings due to overstaying a visa. However, after being greatly inspired by this wonderful forum, I gathered all the evidence I could and sent it in July 2017. After I got my receipt number I heard nothing until October 2018, when they sent me an RFE for Good Moral Character,  Termination of Prior Marriages (I was married and divorced before) and Section 204(g) (because I was removal proceedings). The GMC and Termination of prior marriages were easy but Section 204(g) was intimidating. Every lawyer I consulted told me that it was going to be next to impossible to get approved because the burden of proof is much higher when you are in removal proceedings. However, I believe only God knows my destiny, so I did not get discouraged. I started to research in this forum of how on what I could send to reply to Section 204(g) which basically wanted more evidence to prove the marriage was real. Thanks to going to the old pages of this forum and particularly reading all of @sandranj  advice, I felt confident enough to send back the RFE on January 10, 2019. On March 9th, 2019 I got an alert saying I GOT APPROVED FOR FORM I-360. I really want to thank everyone who contributed to this forum and I will pray for all of those who are waiting for their results and who are thinking about filling.

After I got card, but got email.

Hi Sandra

Thanks for your reply. I was asking about the update on my RFE submission. After submitting all the papers for RFE , USCIS didn't have updated online that they have received my RFE answer. Still online status is the same as "Request for Additional Evidence Was Mailed".  I have tracked the RFE packet delivery and its successfu;y reached and received by USCIS but still no update for they have received it. I am just worried as its more that 90 days passed of RFE reply deadline. I don't understand what exactly going on with my case. Is it like they haven't received my RFE answer in 90 days  time period ?

I am going to send i765 for my EAD extension, since it’s been an year I last did. Just want to make sure if the list of docs below is good to send with i765. Let me know if I am missing anything

 

1. Copy of current EAD

2. Copy of i485 receipt (category is C9)

3. Copy of Passport

4. 2 pictures

5. Finally the i765 form itself
