Question Sandra, have you dealt with NC field offices before? Have you seen them place I485 in abeyance for I360? I'm all nerves for my interview on the 19th and I know so many people have been successful with this process. I just wanted to know if you've dealt with NC personally before. Thank you.

Gm everyone.. Can anyone say how long it's taking to get an interview date for nyc?  Originally submitted April 2017 . Vawa approved Dec 2018 ..courtesy letter February nothing yet.  I

It’s impossible for me to remember.I handled thousands of cases, but don’t look if the local office  holds or not the AOS because the field has many officers.

I went to my I-485 appointment on 2/27/2019 and they told me that they would let me know within a couple days if I was approved or not. On 2/28/2019 my status on only one of my uscis account was updated that I was approved. The other account that does not require the verification code to log in has not updated yet. Since 2/28/2019 my status has not changed and I have not received my GC yet. I'm so anxious to receive it and finally visit my family.

 

The interview went smoothly yes or no questions and my lawyer answered my illegal entry dates.

 

How long before I receive my GC?

Yes, you go and file.

I've applied for VAWA after my divorce was finalized, because in between moving out, divorcing my abusive husband, settling and being a single parent I didn't even have time for gathering all the documentation for VAWA to say the truth I didn't even know that VAWA exists.

I found this on USCIS website - https://www.uscis.gov/humanitarian/battered-spouse-children-parents/questions-and-answers-battered-spouses-children-and-parents-under-violence-against-women-act-vawa

It says the following:
 

Effective October 28, 2000, you may file a Form I-360 if you are still married to your abusive spouse or, in certain circumstances, if you are not still married to your abusive spouse. If you are not still married to your abusive spouse when you file Form I-360, you must meet one of the following exceptions:

 

You believed you were legally married to your abusive spouse but the marriage is not legitimate solely because of the bigamy of your abusive spouse.
Your abusive spouse died within 2 years of filing the petition.
Your abusive spouse lost or renounce his citizenship or lawful resident status due to an incident of domestic violence
Your marriage to your abusive spouse was terminated within the 2 years prior to filing of the petition, and there is a connection between the termination of the marriage and the battery or extreme cruelty. 

So, I am confused. What should I apply with after the divorce?

I do not how to react to this. Since morning I am feeling lot of anxiety. 

 

Today I got a reply on my VAWA case that my I-360 Form, Receipt no.

On March 6, 2019, we ordered your new card for Receipt Number xxxxxxxxxxxxxxxxxxx and will mail it to the address you gave us. If you move, go to www.uscis.gov/address change to give us your new mailing address.

What does it mean ?😮

If anybody has ever seen this before, I think so , It might be with many ?🙄

 

I replied RFE in Oct-2018 and now this is the first update . I filed VAWA 23 around months before. 😰

March 5, 2019 – Approved EAD C31 (18+ months)

Many many people have applied for citizenship after VAWA. Use the search feature. Its been talked about in the past VAWA thread a few times. I know there is a memo or pdf of some sort that explains how VAWA is allowed to apply at 3yrs and many people send it with their n400 to avoid getting it mistakenly rejected.

So, I am confused. What should I apply with after the divorce?

I do not understand your question.

 

The above basically explains in order to qualify for VAWA you need to either be still married or you divorced or your spouse died with in the last 2 years. Its calculated based on the date you get the NOA- so if you are divorced your divorce can not be dated more then 2 years prior to your NOA date.

When you get an update on your 360 that a card has been issued it is for the c31 EAD, you should get the EAD soon and it means your 360 was APPROVED. Congrats! Have you filed the 485 yet?

I have EAD in my hand,  already approved and got via C09. 

I filed I-485 with I360and I765.

 

I have not recieved any update on I-485 so far. 

if there is something  regarding card , Is it GC  🙄?

Unfortunately you still have a wait for the GC. Once the 360 is approved you have to wait for your case to get the local office and an interview to be scheduled. Check your local office processing times to see about how long that wait is. 

 On the 360 form is a place to get a EAD c31 based on the 360 approval. Many times people check that box even if they got a EAD c09 based on 485. USCIS can issue you EADs in different categories. You only need ONE EAD, so its been posted in this thread to send back the second EAD c31 explaining you already have a c09 EAD

The card issued update on the 360 is when an EAD c31 has been sent, and again that is only sent when 360 is approved. For whatever reason the EAD card being sent update shows up on the online system before the 360 was approved message. The 360 approved message should be displayed shortly.
