Everyone that i know left the U.S with advance parole they came back without any probem, in December at list 25 people that I handled they AOS/VAWA travelled and return, but if you have a removal order pending or administratively closed then  you should not travel.

Yes you will need to file I-912 for your I-131 if you cannot afford to oay the USCIS fees.

No I don't... My vawa was approved December 2018 ...this lawyer a mess.  Ty Sandra

I've filed I-360 on May 31, 2017 , my I-485 is pending from  August 2016.

So far I got Prima Facie and 2 extensions,  2 RFE on my moral character and a long wait and silence, and finally, February 14, 2019, I got a notice from them that my card was produced and they are mailing it to me. So I've thought it would be my GC, naive me :)

I got an EAD card c31 category instead not even applying for it as I didn't send my I-765 form, waiting for VAWA approval first. 

Since my EAD card is based on my VAWA case, should I hope it was approved already? 

Does anybody have the same experience?  

 

P.S.: In addition to my frustration, my EAD card came with an error, they got my DOB wrong:(  since I didn't file any I-765 form just I-360 where my DOB is right.

I'm positive it's their mistake. I've read a lot of information, some people say don't bother, look for work as employees care only if it's valid or not, but how I can renew my DL and get my SSN with the wrong DOB. Is anyone here experienced something like that? 

Please, guys, advise 🙏

 

 

 

 

 

Submit the original doccument to the USCIS ansd aske them to fix it and ask to expedite as well  because of their error.

You can file a motion if there is a mistake by USCIS or if you have new information to submit in your case, but just file a motion because you don't agree with their decision then don't waste your time, USCIS is discretionary.

 

You can file VAWA again but make sure you will cover all points that they mentioned that you didn't satisfy them.

Your information is not correct, if the person submit a new Vawa the VAWA petition will be a new case, they will not reopen the previous VAWA at all but they will compare the first VAWA case just  to see if they find any discrepancy in the new case, and yes the person has to start from scratch.

Your attorney wil go there with you to ask to put on hold that is it.In over 17 years i saw just 2 cases that USCIS  decided to go ahead with the I-485 interview before the VAWA approval,and one of the officers made a mistake issuing a green card for 2 years instead 10.I contacted them and they issued a new with GC with the correct expirtation date .

It dosent start from scratch.... we have a case like that here on the trend.. go ask the person, when his case was reopened its did take 3months before the i360 was approved .... my lawyer also told me abt this.... it's an appeal to reopencase and correct ur errors and continue...

Hey Sandra

One of the member here said they went to the AOS interview in NYC and the IO said they can"t put the I485 on hold because this office does not adjudicated vawa cases, that means it will it be automatically denied what can we do in these case for NYC applicants

Mine got denied after the officer said yes she will put on hold here in nyc.They a mess here in NYC.

Did you already, had file for I360 when you attend to your interview? or you was going to file ?

@FeDaniela The same thing happened to me at my interview. My lawyer was with me and we asked to have my I485 be held. The officer said they can't have my I360 because it was only for I485 interview. She said she was gonna put a "no-show" note since my ex- wasn't there with me. She was rude! My I485 is still active now. I though they were going to deny it.
