I believed that to get expedited EAD, you need a job offer or your current ead about to expire and your employer give you a letter to uscis for quick renewal. But don’t you think it’s too early to ask for expedited EAD? A first time December 31st applicant. That’s bearly one month few days ago.

I know it’s early considering I just got a receipt for c9,but if you read my previous post,my attorney apply early 2018 not knowing he file under c31 and I was waiting rejoicing that I will soon be receiving EAD.

i was frustrated and disappointed.Either ways I have to wait,trust me it’s been hard surviving

@Bryan12 Hi. It truly is very frustrating waiting for almost 6 months to receive an EAD in order to work, and sometimes when it does arrive, it takes prospective employers another one or two months to "verify" their status, meaning that most people have to wait nearly one year to work. One would think that it would be a priority for them to promptly issue EADs to those who qualify, that way, they'll have less people on welfare.

That said, they're currently processing EAD applications filed September 26 2018.  Sad as it is, many applications had EAD filed under category C31 and when the error was discovered, and EAD reapplied under C09, USCIS only starts counting from the receipt date of the new EAD application, so yes, patience is key right now, I truly understand that it must be so unbearable trying to cope without a job, especially in this economy, and the bills keep coming non-stop.

@Bryan12 I completely understand your earlier post. how I wish I’m uscis, no one will have face this double jeopardy. But we all know uscis won’t pardon your lawyer mistake. Your EAD c9 will surely come. But your fight will begin when it’s out of processing time. I filled for expedited EAD c9 via my Congressman aswell  and was granted. But I believed it was granted not because I have the best reasons. But  because it’s already out of processing time, therefore uscis has not excuse for denial. It was 7months. Keep the hope alive. God bless

I am F1 student. The EAD card ( category C09) under I-485 was sent to my mail in august 2018. My I-360 was received by USCIS in October 2018. USCIS sent me Prima Facie notice in November 2018. Now I am about to graduate in May 2019. I have been offered a job by a company recently. The company  is able to sponsor and apply for Green card or H1b for me if I have OPT-EAD. I am thinking about to apply for OPT-EAD

 

My questions are:

 

1. If I apply for OPT- EAD, would that affect my I-360?

2. or, What would be the best solution in this situation? 

3. What kind of status I have right now ? Because I have now F1 status and also my I-360 is pending.

You can apply for H1B as soon the window cap opens (April 1st) make sure you will submit your application within 24/48 hours because the cap closes within days, you must have the licenses for your category ready when submitting the application.

 

There is no problem because your l360  is pending .

 

Your status now is student .

She filed under category C9 because her AOS is pending and she needs to work. Attorneys who file under category C31 when the person has adjustment pending is because the attorney has no clue about Vawa.

Hi @sandranj thanks so much for responding! I was unfortunate that my interview was a week or two before the incident happened so we filed VAWA after my interview and of course the IO denied my AOS bec I went alone and IO said the local office can’t adjudicate VAWA case.  Is there a way that my EAD gets approved the soonest possible time? I have my EAD before under c9 but it’s expired already.

You have to contact the police  from your Country and ask them what is necessary for you to obtain the police clearance, each Country has their own policies then is advised that you contact them directly to find out what they require to get the clearance ok.

 Hello @Sandra and all, kindly advise, i applied for renewal of my EAD category C09. About two weeks now. I am yet to have any update.
Will there be any update or change on the online account I have previously when i first applied for EAD?
Or they will just mail me a notice that the renewal application was received?
My i485 is on hold based on my i360 petition.
Thanks for the advise in anticipation.

@Bryan12- Last year there was an influx of EAD petitions filed and the processing time went from around 3 months to 4-6 months. As a result TONS of people started sending in expedite requests. At first many were getting expedites approved and now they are no longer approving expedites as easily. Asking for an expedite is free and wont cause extra delays so you are free to ask for one but it most likely it wont be granted. USCIS wont consider the time you waited while the wrong form was filed. Sorry.

 

@FavouredOne- For a renewal EAD c09 you will get a NOA receipt- this can take 30 days or more. The online status may reflect it or it may not, it is not always accurate.

Unfortunately, Im still waiting 😔 I’ve really been so stressed and anxious. I did raised an SR, USCIS will reply by Feb 26 (praying that I should get one, because some members here say that their SRs are just being ignored), already went to infopass (it was no help, officer said they’re  still processing and can’t giveme much info). My last hope would be my Congressman, I will call on Monday to request to expedite my EAD. What’s your timeline?

That's crazy though... as for me mine is 4months now and I called USCIS to ask this morning,  they told me that it takes up to 5 months, 6months now to get renewal that I should keep waiting... mean while I got a receipt for auto renwanl.for 6moths that's expire April 26, hopefully am gonna hear from them b4 that date , that's what uscia told me
