What's you are saying that  your pervious 485 was on hold vawa got approved and you went to second interview ?

Can you please clear this information .

Hold on i am confused now, which interview did you attend again is that 2nd interview base on vawa approval?

Please gave us more information because what you are saying is confusion .

Don't worry you still have 30 days to reopen the case or motion and you have other options that you can file new 485 and sending letter to your local office asking them not issue NTA based on you filing new 485 so there is not any removal processing .

All it depend on what happened exactly with your pervious case and more information Will help us to give you the best advise .

Timeline: 

  • March 2017- mailed VAWA package to VSC
  • April 18, 2017 - receipt notice of I-360 fee waiver received 
  • April 19, 2017 - update on website that request for RFE was mailed.They were requesting Good moral. 
  • April 28, 2017 - sent RFE: Police report, live scan, clearance from all the places within last 3 years before VAWA application & declaration of good moral character
  • May 10, 2017 - Vermont received RFE reply. Update on May 11, 2017 that they will start to continue on my application 
  • August 25- interview on marriage-base I-485 . Requested  i485 to put on hold. 
  • 9/14 - sent EAD request to Vermont & NBC - written with AR11 to NBC and i765 to VermonT
  • 10/16- NOA receipt of EAD
  • 11/15 - update status that work card was mailed 
  • 07/10/2018 - EAD card was mailed to me for approved VAWA  (I never applied for c31) I got c9
  • 07/18/2018 VAWA approvaL
  • 12/13/2018 - green card interview again. I went alone.  
  • 02/06/2019- rfe for i485 delivered. Rfe to stamp the previous AP w/c the CBP didn’t therefore I-485 denial

Not until a final decision is made on your adjustment of status which is I-485.

And since your I-485 was denied that was a final decision so therefore you can be placed in removal proceedings base on what I understand.

Please include your travel dates, when you left, how you reentered, what did you try to get from CBP, what was expired, what you submitted as RFE response.

 

Please do not leave the US with out getting a response from Sandra. It seems like the interview in December was for 485 based on approved VAWA but you are having some difficulty showing your last entry so they denied it. You most likely have to file an appeal and get whatever it is they were looking for re your last entry. This is going to depend on the specifics of your case and ONLY Sandra is qualified to give you advice.

You need to talk with lawyer ASAP .

You have 30 days to Reopen or Motion and you have to approve to USCIS why you couldn't to get the stamp with Reasons you need to approved it .

Please you need to hire lawyer .

I explained to USCIS that CBP will not stamp it because it was expired document (2016) and I explained it in my declaration. They denied it

Oh i understand now the situation it was a very big mistake not to lets the officer stamp in your AP or you forgot to have them stamp your AP for reentry.

Even tho you are physicaly in the country but in their data base considere that you still out of the country but how come you get in the country and at airport without inspection.

My visitor visa was valid then so I presented my passport like I usually do and they stamped me with visitoovisa and let me In

When you were going out the country they stamp on your AP  not your password isn't it ?
