Can I apply for a new I-485 in the middle of this one being denied and them telling me to leave country?

@Mnmnm Well if the reason for denial is abandonment you just need to write a letter highlighting that you were under the impression that your I-485 was placed on hold and would be adjudicated after your VAWA was approved. Why did they say it was abandoned? Did you miss an interview or a correspondence they sent asking for additional info?

It was abandoned because I forgot to present my AP when I re entered.

@MGJ_NY Wow, that is such  long time!! Please try to do another infopass. It is so disheartening that after everything people have been through, that they still have to struggle because they don't have the necessary documentation to work. One would think that VAWA cases would have priority adjudication instead people are having to wait long periods of time, and for some of us with young children to take care of. I wish they would shorten the adjudication time frame.

I'm praying for us all. Please let me know how it goes with your EAD, it seems it is taking longer these days 😞

Hope this helps others for reference and information. Also note every case is different but this is a general timeline per say. Patience is key and getting support from each other in this forum will help out a lot. It helped me throughout all that time.

What do u mean u forgot to present AP when u reentered? How did u return to the US without if u don't have a GC or 551 stamp in ur passport?

 

You can refile the I-485 based on VAWA with supporting evidence and a copy of VAWA approval letter.

 

You will have to start over in line, but you will have your EAD

Now you are talking they might think you are still out of the country, also when you asked an OI to hold your I485 there is like 50% chance to hold or Denied this time it is up to the IO.

The good news is you have an approve I 360 now you can submit a new I 485 base on that.

No I attended the second interview after the VAWA approval. 

If I apply for a new one I was wondering what will happen to this old i-485? The letter gave me 30 days to leave the country. Do you have an idea?

@Mnmnm You attended an interview after your VAWA was approved but they still said you abandoned the case? That is really odd and you need to have an experience lawyer analyze the denial and make sense of it because without the entire letter we will be unable to really tell what your next step should be.

When I attended the interview they gave me 88 days to go to CBP office and get the parole stamped but CBP didn’t because it was expired document. I explained them my situation and the uscis sent me a denial.
