OCT 24, 2018- RFE was sent to me (good moral and bonafide marriage) My psychological evaluation was not sent yet, me and my lawyer are waiting for another RFE for that, in case they ask for one

 

DEC 14, 2018- My Response to RFE was received by USCIS

 

Didn't receive prima facie and still waiting for my EAD renewal. It’s been expired since OCT 2018.

 

 

Thank you for responding @MGJ_NY. Mine was filed on 9/4/18. I went to the interview alone last 7/18 and my application was denied bec the local USCIS center can’t adjudicate VAWA cases. My EAD expired last month😭.

They can not deport you, you just have to continue with the new application and let USCIS because Service Centers don’t comunícate unless you submit the copy of previous applications in the new packet. I did it this way and so far I haven’t got any issues, I am currently waiting for my I485 to get adjudicated, I am about to email my lawyer because it has been almost 4 months now without notifications even though on today’s date it takes 4-6 months but still I will make an inquiry by end of the month. I hope this explanation helps.

Here is a link I found about the latest funding bill passed by Congress on Thursday night  that does not include an extension to reauthorize the Violence Against Women Act, despite its expiration on Friday.

 

Apparently, this is a plan for the Democrats to have more leverage to negotiate a broader re-authorization of VAWA outside the confines of the spending deal.

You’re welcome! You’re from NY too, right? My IO also told us same thing and Didn’t confirm if she’s really going to put my I485 on hold. My attorney sent a mail to USCIS the next day, stating our experience and asking to out my I485 on hold. We didn’t get a response. There’s no even update online.

 

2 weeks age, I went to infopass for my I765, asked about my I485, officer said it’s still active. 

 

Did you file a new I485 already and EAD renewal?

Yes! I’m from NY too. They didn’t hold my I-485 bec according to the IO, it was marriage based and there’s nothing that they can do about it if my ex wasn’t there for the interview. After denial, I filed for VAWA and yes it’s a new I-485 @MGJ_NY . I can’t file an EAD renewal bec that was under C09 and now I’m under C13. Is your EAD C09?

Oh ok. When did you file your EAD? Yes, my EAD is renewal under C09. The last update was fingerprints reviews was completed. It’s been 6 months 😣

EAD was filed 9/18. You’re lucky it’s under C09. I had my prima facie then fingerprints. After that, long silence.

Welcome to VJ! Please take some time to read through the previous VAWA threads- you will find lots of great information. Pay close attention to sandranjs responses and feel free to ask any questions you may have... You can also make a timeline. From reading your posts it seems you had filed an AOS packet with your spouse and went to the interview. People typically ask in the interview for the 485 to be held while the 360 is processed and they usually hold it unless your spouse pulled support of the AOS. Im not sure if thats what happened in your case or if they just chose not to hold it but it seems your previously filed 485 is dead now and if Im correct you filed a new one right? Did you file 360+485+765? If so there are 2 ways for you to get an EAD. One is based on the 485/765 (sent with 360) and thats a C09 EAD and is issued apx 4-6 months from date filed. The other way is to get a c31 EAD based on 360. That will not be issued until 360 is approved (12-16 months) but once 360 is approved the card is mailed right away- still 12-16 months from date filed however.

@MGJ_NY sorry my dear,they seem to be a problem with EAD file in August,because the EAD that i filed in August is still pending it was category C-14,but the one i filed in october category C09 was approved and mailed out already.So i think you should do info pass.Its really sad!

I know. It’s frustrating. I already did infopass 2 weeks ago but the officer couldn’t tell when i should get my EAD. I’ll probably try to get another one. I did SR and should get a reply by Feb 26, 2019, but I’m not really sure what that would do because I’ve read from one member that she/he did 2 SRs and didn’t get any response.

Hi @Damara, thanks for responding. I don’t have the complete dates rn for my timeline but I’ll go through my file.  I’ve asked my IO during the interview to hold it but she said they can’t do that bec mine was marriage based and that I need my husband (now ex) with me during the interview. And yes, I got my C09 months before my interview but when my letter of denial came approx  5 days after the interview it indicated that along with the denial of my visa, my EAD will also be revoked. So, I submitted the all three that you mentioned since my ex was a citizen here. I’m going nuts and the wait is just too much to swallow.
