Are you planning on putting yours on hold? You do that when you go for your interview by simply advising the officer that you would like for your i485 to be held in abeyance..that is put on hold pending your i360 adjucation. Best of luck dear😊

I’m not sure what I NEED to do🤦🏻‍♀️ My husband filled divorce already. 

So if he won’t cancel does it mean that I will be putting in removal process?

 

Thats why I decided that I need put I-485 on hold for not be deported.

I don’t know how long divorce is take.

 

Or. How to attach my pending I-485 to

I-360?🤔😦

From my understanding..you are still eligible for Vawa as you can file even two years after being divorced from your spouse. So what are you waiting for to start your vawa application? It's worth it go get an attorney for legal guidance/advocacy. Your best bet is to act now!!! You are still married until the judgement is final! What's that cliche again..make hay while the sun shines 👍😊 best of luck dear.

Have you gone for i485 interview? That's where you need to inform them about the vawa with your notice of action as proof then it is at the discretion of the officer to put it on hold or not. Act fast and now!

I’m just throwing out this question if anyone knows. If your represented by a lawyer by way of G-28, is it that your local office gonna be where that lawyer practices???

Thanks. I figured just as much. The office is 6 hours away from where I live. I don’t mind. Just have to find a way whenever it’s time for interview.

Hope this helps others for reference and information. Also note every case is different but this is a general timeline per say. Patience is key and getting support from each other in this forum will help out a lot. It helped me throughout all that time.

Accident to what @sandranjsaid : YES

and actually better for us from the financial side, cheaper for us to fly there then flying  your lawyer even though totally worth it but still very expensive at least $2k plus traveling cost,food,taxi.

JULY 17, 2018- I485 interview, went and asked the officer to put in on hold since I’ll file VAWA

 

AUG 10, 2018- Receipt Notice received for my EAD renewal under pending I485

 

SEPT 7, 2018- Sent VAWA Package

 

SEPT 11, 2018- Receipt date for VAWA 

 

SEPT 20, 2018- Fees are waived

 

OCT 24, 2018- RFE was sent to me (good moral and bonafide marriage) My psychological evaluation was not sent yet, me and my lawyer are waiting for another RFE for that, in case they ask for one

 

DEC 14, 2018- My Response to RFE was received by USCIS

 

Didn't receive prima facie and still waiting for my EAD renewal. It’s been expired since OCT 2018.

@HolaBola31not sure but in my case I cancel my previous I485 and my 1130 got revoked because my ex- called immigration on me BUT I had already told USCIS about my new I369/vawa Packet so I read all this thread about previous pending I485 ... very confusing.

They can not deport you, you just have to continue with the new application and let USCIS because Service Centers don’t comunícate unless you submit the copy of previous applications in the new packet. I did it this way and so far I haven’t got any issues, I am currently waiting for my I485 to get adjudicated, I am about to email my lawyer because it has been almost 4 months now without notifications even though on today’s date it takes 4-6 months but still I will make an inquiry by end of the month. I hope this explanation helps.
