Hi @Favoured Queen👑 thank you for your reply and encouragement. It felt like my hopes went into a nosedive. I thought my EAD would come sooner as it shows Vermont’s current processing time is at 9/18. It’s crushing me. I lost my job and couldn’t get a regular job. Did you go through the same process? Can you please share your timeline and experiences? I am new to this forum so I am gathering information and facts from VAWA filers. I truly appreciate this @FavouredQueen

Are you planning on putting yours on hold? You do that when you go for your interview by simply advising the officer that you would like for your i485 to be held in abeyance..that is put on hold pending your i360 adjucation. Best of luck dear😊

I’m not sure what I NEED to do🤦🏻‍♀️ My husband filled divorce already.

So if he won’t cancel does it mean that I will be putting in removal process?

Thats why I decided that I need put I-485 on hold for not be deported.

I don’t know how long divorce is take.

Or. How to attach my pending I-485 to

I-360?🤔😦

From my understanding..you are still eligible for Vawa as you can file even two years after being divorced from your spouse. So what are you waiting for to start your vawa application? It's worth it go get an attorney for legal guidance/advocacy. Your best bet is to act now!!! You are still married until the judgement is final! What's that cliche again..make hay while the sun shines 👍😊 best of luck dear.

Have you gone for i485 interview? That's where you need to inform them about the vawa with your notice of action as proof then it is at the discretion of the officer to put it on hold or not. Act fast and now!

Hi Trizzle..just about going to bed..I think according to what I've read here from Sandra's response to a similar question YES 👍

Thanks. I figured just as much. The office is 6 hours away from where I live. I don’t mind. Just have to find a way whenever it’s time for interview.

thanks for your rapid response.  The issues I cannot get police clearance letters from each city I have lived in is because I lived in New York before but lived in Bay Area California now. It is hard for me to go back to New York to get those letters. So, I am wondering that I can get a federal criminal background report which will require a fingerprint and it is for nationwide, instead. I got my 1st prima facie valid for one year and have not yet received any RFE yet. I submitted a lot of evidence to support my case, restraining order, police report, phycologist evaluation report, joint account, wedding picture, neighbor affidavit statements, and so on.

If you hv no rfe dont punic,, wait until immigration ask you. For more evidence..

I’m just throwing out this question if anyone knows. If your represented by a lawyer by way of G-28, is it that your local office gonna be where that lawyer practices???

Accident to what @sandranjsaid : YES

and actually better for us from the financial side, cheaper for us to fly there then flying  your lawyer even though totally worth it but still very expensive at least $2k plus traveling cost, food, taxi.

@HolaBola31not sure but in my case I cancel my previous I485 and my 1130 got revoked because my ex- called immigration on me BUT I had already told USCIS about my new I369/vawa Packet so I read all this thread about previous pending I485 ... very confusing.

They can not deport you, you just have to continue with the new application and let USCIS because Service Centers don’t comunícate unless you submit the copy of previous applications in the new packet. I did it this way and so far I haven’t got any issues, I am currently waiting for my I485 to get adjudicated, I am about to email my lawyer because it has been almost 4 months now without notifications even though on today’s date it takes 4-6 months but still I will make an inquiry by end of the month. I hope this explanation helps.

stay strong!
