Thanks for the reply.

I am not giving too much hope really. The abuser doesn’t physically assault me. It’s more of a financial and psychological abuse. He failed my GC and EAD. I cannot work or drive. He is not supporting me. And I have a son to raise.

That's not unusual in vawa cases..the abuser doesn't have to physically abuse you for you to qualify. The patterns of abuse you mentioned are just as detrimental. Now quick question..do you have a psychological evaluation following the abuse you endured? If no you need it. Good thing you came to this site..personally I have learned more here than from my attorney!😊 what documents can you say you and your lawyer have put together to strengthen your case? Be sure to make your own research as having an attorney is not all that reassuring from what we have witnessed from a few folks on here.

I do have a mental evaluation report. It’s very long. They asked me a lot of questions. I don’t have health insurance so I can’t afford a few sessions of psychological therapy.

I only have one witness since I can’t leave the house. I don’t have a vehicle or a license to drive. I cannot work. I stay home with my son everyday. I support myself and my kid by using the money that I have saved when my work permit was still valid.

My son is on Medicaid. The government won’t give me health insurance. I used to help pay off my husband’s student loan.

Sigh. I feel weak.

My heart goes out to you and all others suffering because of the inhumane acts of demonic spouses..but I believe strongly we will all laugh in the end. Aside being granted relief through vawa, there is a GOD above that sees in secret and will reward openly. Be strong my dear. Take advantage of everything at your disposal this includes the affidavit of that one person you said witnessed your maltreatment. Also the long mental evaluation. Everything and anything that can strengthen your case is needed. You don't have to have it all..the USCIS knows all circumstances are different and are well trained to work with what is before them as long as it meets the qualifications. Like I adviced stick around you'll not regret it😊 we are all here for each other🙏🌼

Thanks. I didn’t receive courtesy letter as yet becuz I had gotten initial evidence request for copy of my original birth certificate and the lawyers are taking forever to send 1 simple document as that. They are so basic they didn’t send it initially.

I am very sorry for what has happened. Unfortunately as explained already cheating is NOT grounds for VAWA nor is your depression/mental issues from the cheating/breakdown of the marriage qualify you for VAWA. Please be cautious about an attny that encourages you to file based on that.

I was told by 2 different lawyers already that thread of immigration status (if you do not sign divorce papers right now, then I will call USICS and kick your ### out of the country like tomorrow)  and other threads (if you do not sign divorce papers right now I will take everything from you because they favor wife in this state) qualify me for VAWA together with my broken psychological state due to cheating. What do you think?
