Hi Sandra,I do appreciate you for everything you have been doing  for pple concerning their Vawa cases in this group,pls I have a question I applied dec 2017  Vawa ,receipt Jan 2018,ead and adjustment March 2018  ,additional evidence feb ,I replied March,I got my primea determination March as well, I got my ead Jan 302019 under category c31and my Vawa does change yet,also I applied ead for my kids only one got ,,,your reply will be useful thanks may God reward you for real🙏

I'm not able to afford a lawyer and have tried all of the local organizations that provide free and low-cost help, without any luck. One actually told me "We don't work with VAWAs because they usually can't pay much"

 

I'm basing my petition on extreme cruelty with only two instances of physical abuse which I didn't report to the police. I have no friends (my spouse wouldn't allow me to get close to anyone regardless of gender) and cannot afford to see a counselor. I know it's going to be really tough to prove 'extreme cruelty' without third-party evidence but I have to try. The other elements of the affidavit (abuser is a USC, good faith marriage, good moral character etc) are not an issue but I really need to be sure to show sufficient evidence of abuse. I can put it together but really would like someone to review how strong of a case it is.

When the attorney lives in a different State than the petitioner then USCIS schedules the interview where the attorney has his/her practice.

@sandranj do you mean that since my attorney lives in Chicago and i live in Ohio they will schedule my interview in Chicago?because i have been doing my biometrics in ohio!please help me i need to know!thanks alot

My lawyer emailed me today to advise that he received interview notices for my son and I however, the notice states that the interviews are in ATL despite the fact that we submitted an address change from ATL to PHL several months ago and received acknowledgement from USCIS confirming the change.

 

I am so frustrated because I think I will have to wait several months more to have the file shipped to PHL and the interview arranged.

 

my VAWA was approved in September 2018 and the interview was scheduled for February 15th 2019.

 

If anyone sends a change of address update to USCIS please double check that it was actioned even if they send you an acknowledgement. 

 

Please check what sandranj said and plan to attend your interview in Atlanta please I hope you get your airticket and tell your lawyer that you decided to attend the interview

Hi guys, as I posted before I was recently cheated by my wife and she is filing divorce. I spoke with one lawyer and she asked if my wife was treating my immigration status or did she ever say anything abusive to me, etc...So yes, my wife said me things like if you do not sign divorce papers right now, then I will call USICS and kick your ### out of the country like tomorrow as well as if you do not sign divorce papers right now I will take everything from you because they favor wife in this state...also she said things like it was easy to lie to you because you an idiot. She said much more...this is just what I remember now...Also I am seriously psychologically down by this and even my wife suggested me to see a therapist because of my mental state. So I am going to visit a therapist.
My questions are: does everything I said above make sense for applying for VAWA? and one more question...does this VAWA petition affecting my wife or not? Just want to ask her mom and sister to write a statement about what happened and to confirm that she cheated. I will not ask them if it is affecting my wife, because obviously they will not do anything against their family member. So...

They schedule the AOS interview where your attorney has his/her office.In order for them to schedule the interview in your State the attorney has to inform this to the USCIS.

I am very sorry for what has happened. Unfortunately as explained already cheating is NOT grounds for VAWA nor is your depression/mental issues from the cheating/breakdown of the marriage qualify you for VAWA. Please be cautious about an attny that encourages you to file based on that.

You are welcome to this amazing forum. Every detail should be given attention as even the littlest detail could mean the difference between approval or denial. That being said..we don't know what and what you and your lawyer has put together to inform our opinion..nevertheless be sure to have a good case..lawful relationship with spouse, establish abuse, proof good faith marriage/residence, good moral character ...pretty much these but whatever else I'm missing there are a lot of knowledgeable folks here to chip in. I am not giving too much hope really. The abuser doesn’t physically assault me. It’s more of a financial and psychological abuse. He failed my GC and EAD. I cannot work or drive. He is not supporting me. And I have a son to raise.
