I'm not an expert and am just starting getting everything together for a VAWA petition. I've also seen the news articles about VAWA not being reauthorized, but according to the USCIS website (https://www.uscis.gov/humanitarian/battered-spouse-children-parents):

 

"The VAWA provisions, which apply equally to women and men, are permanent and do not require congressional reauthorization."

I need help in getting a free legal service as I cant afford my lawyers bill of 7000.

Yes, I know of someone that successfully filled early January 2019 during the shutdown and it was accepted.

Does anyone know of any organization that will review VAWA affidavit free?

 

I'm not able to afford a lawyer and have tried all of the local organizations that provide free and low-cost help, without any luck. One actually told me "We don't work with VAWAs because they usually can't pay much"

 

I'm basing my petition on extreme cruelty with only two instances of physical abuse which I didn't report to the police. I have no friends (my spouse wouldn't allow me to get close to anyone regardless of gender) and cannot afford to see a counselor. I know it's going to be really tough to prove 'extreme cruelty' without third-party evidence but I have to try. The other elements of the affidavit (abuser is a USC, good faith marriage, good moral character etc) are not an issue but I really need to be sure to show sufficient evidence of abuse. I can put it together but really would like someone to review how strong of a case it is.

I am so sorry to read your story, be safe 1st of all.

I am not a lawyer but I know you myay have evidence to proof the psychological abused.

Did I recorded his abused?

Do you have pictures of the physical abused?

If you have kids, did they saw the abused?

You must have letters from friends and family that saw this situation.

Doctors visits and therapy sessions.

Plus all documents like bank statements under both names, medical insurance, mortgage, rental agreement, births certificates, copies of ID or DL,copy of passport both of yours, marriage certificate, etc...

This is just to give you an idea of everything you need ready in hand plus $1725 dls for all the applications.

I received an update on my case.

 

My lawyer emailed me today to advise that he received interview notices for my son and I however, the notice states that the interviews are in ATL despite the fact that we submitted an address change from ATL to PHL several months ago and received acknowledgement from USCIS confirming the change.

 

I am so frustrated because I think I will have to wait several months more to have the file shipped to PHL and the interview arranged.

 

my VAWA was approved in September 2018 and the interview was scheduled for February 15th 2019.

 

If anyone sends a change of address update to USCIS please double check that it was actioned even if they send you an acknowledgement.

Why don’t you fly there? Isn’t easier at this point to be done? Just a suggestion. I don’t have any idea about the address changes with USCIS.

MaybI ask you which date was the approval? so I can use it as referral, I am waiting for my medical and interview to be set since 10/29/2018 of my approval. Thanks in advanced and  Best Luck!

I can get copies of all the required documents but the only witnesses to anything have been my step-children. I can't ask for affidavits from them as they will take their parent's side of things. They'll also tip-off my spouse to what I'm doing and it's vital they don't find out. That's my dilemma.

Approval date was sept 8th 2018. My lawyer says I shouldn’t fly to ATL to do the interview because once USCIS asks to confirm my address and I do they will realize that they do not have durisdiction and stop the process.

i am in atlanta to so it looks like scheduled  interview real fast in atlanta so u got approved in september 2018 and got interview for feb 2019

If you look approvals the average timeline from start to finish is about 2 years IF you apply on 2016-2017, I had read other threads ... by the time we are done is almost closer to the date we filed after almost 2 years.

@Willow81 mentioned 9/8/2018 approval in another post but will be awesome if you can share all your timeline from the time you started, thank you in advanced and congratulations 🍾🎉

I sent 3 times address change to VSC,

11/24/2018 sent 

1/5/2019 sent 

1/15/2019 sent 

 

but I didn’t get any confirm from Uscis 

 

so your mean is you received confirm address change from VSC ,right ?

If I were you I would fly there then if they have to move it atleast I appear, I wouldn't risk making them that I abandoned by not appearing,  but if your attoney is in Atlanta I guess they always sent the interview to his/her nearest field office not your office, but sandranj can chip in it.
