Then like 1 week ago she told me that she is sleeping with someone from work, she is moving out ASAP and moving in with him, also she is filing divorce, also all that gifts was from this guy and that secret admire was that guy. So, she lied me and her family for a long time. After she told it to everyone, her sister and mom stopped talking with her and cancelled their planned vacation together (they told her, we dont want you to come and be with us). They all dont communicate for a week already, but her sister and mom are talking with me and supporting me, they agree she cheated, they agree she acted inhumanly and very dissrespective. She filed divorce today. During this week we were fighting a lot because we still live together...while this fights she told phrases like: "You are an idiot and it was so easy to lie to you", "I will destroy you, test me and watch", "If you do not sign divorce papers right now, I will take everything from you because they favor wife in this state", "If you do not sign divorce papers right now, I will call USCIS to withdraw my petition and kick you out of this country like tomorrow", "My future is brighter then yours".....etc. Her mom and sister agreed with me that she is doing this because of money (that guy is rich)...she was proudly saying like he will get me a ring for 40k...I will not be able to say NO (after saying to me that she does not want to marry again)...he will pay for my plastic surgery and he will pay for business I want to start, and I dont need to work at all, I am leaving my job in June...because he has a lot of money and he will pay for me. I didn't record her saying any of that, so it is only my personal statement.

During all this is happening she realized that I am very psychologically distressed...I am really down by this. I can't believe my wife cheated on me and how she is acting towards me now - very aggressive and with no pity. So, she said I need to go to therapist because I need mental help. I agree with that because I was never so much down in my life, I really need help. So she will take me to the doctor I guess, or I will go alone. I will probably need multiple visits because situation with my mental state is very hard. I do not even believe what I am typing now here for you. I want to believe that this isnt my story...but it is. 

So after saying all of this to random lawyer I called today...lawyer said that apply for VAWA. I am thinking is there any sense in applying or it is just a chance for lawyer to make money and this is why she is telling so?
Please advise what are the chances of getting VAWA approved, especially for man.
P.S: I am now pending AOS from K1, interview was not scheduled yet. I have an EAD and AP (will it be cancelled and when in case I am applying for VAWA and not applying?)

It’s sad to hear this. But more sadly, cheating is not a ground for filling  vawa. Sandra mentioned this million times already.

I came into the country in May 2017 with my daugther. I got married to my soon to be ex husband in March 2018..Our marriage lasted only 2month as I was abused on some occasions which one of them includes my 7 year old daughter been involved. He at first seized my daughter n I passport,my phone and all documents we were keeping for the green card filling..Eventually I got my passport back .The only evidence I have is Our marriage certificate, copy of his birth certificate,a copy of his i.d,letters from friends and social worker and just our wedding pictures(as my phone got broken by him and the second phone was forcefully taken from when so I wont call the police during the last physical abuse...We could not open a bank account because I Did not have social security. We could not get a house too and we were staying first at his mother then later my cousins. I ran away from Indiana to Maryland when I could not take the abuse anymore..I am saying a lawyer who said I should file for Asylum and vawa.  My questions are:Can i still file for vawa with the new saying it has expired?.. I need help in getting a free legal service as I cant afford my lawyers bill of 7000.

I responded back to my RFE just last week, have not got any acknowledgement from them that they received it. still waiting and

She can not get you deporterd ,, stay away from her dont touch her ,, dont give her any chance to call police on you,, some people are evil can lie any thing on you so just be very careful...

This is a really tough situation and I hope that you’ll be able to heal from this. @sandranj is the expert here but she has mentioned many times that cheating is not grounds for VAWA, because it is not abuse, but an unpleasant marriage. You’d have to be physically and/or emotionally abused: threatened by her, isolated from friends/family, made financially dependent on her, called names and belittled, etc as part of her controlling you. 

 

Maybe you have a case, I am just repeating what Sandra has mentioned over and over on this forum.

If you pay the initial fee there is no fee to renew the I765  if you are using  same category C9.

Cheating is not ground for VAWA, not even if you got depressed because of the cheating.

Your attorney screwed your VAWA because he didn't ask you to get  the police clearance from your Country. USCIS just issues a  request of evidence if the person missed to submit some document,  and clearly you can see that he is  imcompetent as well.

 

You can renew  the work permit without his "help".  Fill out  form I-765 and send me to review and I will let you know if everything is fine. He probably filed a motion, and a  motion takes around 5/6 months to be adjudicated.

Exactly what i diagnosed at first sight! Lol @ the lawyer iis a thief! Sad we have dubious attorneys everywhere preying on both ignorance and desperation of unsuspecting victims who are vulnerable and gullible! SMH thank God we have SANDRA!👑 Godbless you dear.🙏😊😘
