You are still within the time frame, mine was answered after 32 days but the normal time frame is 45 days average up to 60-90 days.

@Tony1912 No you don't, I had my interview last month and have not filed for a divorce yet.

Timeline: 

May 2016 retained an attorney and started to prepare my VAWA petition. 

11/08/2016 mailed my packet

11/28/2016 USCIS rejected my packet (expired forms) :(((  

11/29/2016 Mailed my packet again Via ExpressMail (I-360, I-485, I-864w, I-765, I-912, G-325A) with previous rejection notice on top & a request to expedite EAD

12/14/2016 Date on the NOA  

12/31/2016 Attorney emailed my Prima Facie (Notice date 12/19/2018)   (180 days)

01/14/2017 Mailed my husband’s birth certificate with the blue receipt that came with my Prima Facie

01/17/2018 I-360 online Update (correspondence received)

12/25/2016 Notice for Biometrics

01/12/2017 Biometrics completed

01/31/2017 EAD update (Ordered my new card)

02/04/2017 My first EAD delivered.

Idk but is it's preferable... you don't want the IO wondering why you are still married to your abuser, or in another case... you can go along with paper work showing the you've filed at least for divorce and just waiting on the final hearing.

The IO's main focus is to verify whether there is a reason for inadmissibility not question whether your decision. Whether you file for divorce or not won't affect your AOS eligibility. 

The I-485 interview happens after the VAWA has already been approved and the applicant doesn't need to justify or go through the details to explain the abuse or marriage.

Uscis submits receipt number within 10/60 days.I have cases that people received after 10 days they submitted the VAWA petition.

 

Individual in removal proceedings won’t receive EAD,the person needs to have the proceedings administratively closed or terminated to receive work permit.

@gramercy, you are entirely correct. But is never wrong to be on the safe side. Vawa journey and approval and interview takes like 2years plus to be completed. If one can file for divorce then why not. What's the purpose of still being married after separation for that long with someone who has abused You?

The purpose or reason that may delay divorce are many my dear, custody, financial means, fear & safety :)

Hello everyone, last year December two immigration officers came to visit me. I told them I was now separated from my husband and they told me about vawa. The thing is somehow my husband knows about it. At first he acted like they told him and if u file the form he will tell them it’s frauds then he said they sent a letter telling everything everyone including me said and they are waiting for his response. During our initial interview they said that they would send an RFE for a disposition for a petty theft I had and more pictures. I never received the RFE and I separated soon after and he kept saying he did not receive it. My lawyer told me that I had been put in removal proceedings I didn’t know. I just knew I was denied but I don’t know for what reason. My question is why would my removal proceedings come so fast. It’s in early February’. Just a year after they came to visit me but not even a year after the denial @sandranj

I received NTA 35days after denied.
