Nah, 2018 is not "the most recent year" until April 15th, 2019. 

They either lost it or you did not send a complete copy of the ITR including all pages and schedules PLUS W2s.

Thanks so much! I think we sent everything, but it doesn't really matter now. Do we need to include anything else but the rfe letter and our response?  Do we need to sign the papers?

Timeline

Any US citizen got their W-2 and it says taxable martial status as Single? I was single most of 2018 until end of November.  I want to file jointly this year with my hubby. can i still do that? I am going to ask payroll to update my W4. but just wanted to see if I can still file jointly in the next few months.

For federal income tax purposes you file your status based upon what you were on the last day of the tax year - December 31st.  So yes you can file Married.  In my case it worked out well for me as we got married on December 22 and she had no income to report for 2018 and I got the benefit of filing married filing joint for the entire tax year.

 

The fact that your W2 or w4 says single has no bearing on what you file or how the IRS Recognizes your filing status.  IT only affects your withholding.   You will have less $ taken out of your paycheck for state and federal tax purposes  when you change your filing status to married on your w4.  Generally speaking if you want the largest possible refund at the end of the year then both of you have your w4s as single and claim 0 dependents.     You can play with the numbers by googling tax projection calculators, and there are many different options to play with the numbers.

Hello everyone!

 

My husband is a full time student and working part time. He was recently hired this September 2018 and we are filing now the AOS this February 2019. He used to work back in 2015 and had to stop because he got accepted in his desired University (Also here in the US). I have several question regarding the I-864 affidavit of support.

Our current situation is:

- He didn't made it to the poverty guidelines that is why we're filing a joint sponsor (his dad)

- He doesn't have 3 recent tax return sheet (only 2015, his previous work and 2018 his part time work now)

My questions are:

1. In the part where he should input the 3 most recent tax income, should I leave the other two blank? the 2nd and 3rd most recent?

2. Should I leave this part not checked because he already filed this 2018?

3. As I believe so, the Total Income per year stated in Income tax return is different from current annual income. We will request Certificate of Employment reflecting this current annual income so that it is visible for the checker. I just want to verify if we are correct?

No you will need to input the year and $0 or whatever income amount he did make even if he did not file taxes claiming that amount. 

Keep in mind that if he did have to file taxes and didnt, he will have to file now at least for the three most recent years.

No this question refers to all three years. He will have to check it. Because he didnt file he will have to explain why he didnt for each year individually.

Kind of. You can use a verification of employment if it benefits you. If your ITR for 2018 already meet the FPGLs for your household you can report the income on your ITR as your current income. If your current employment income is better than the 2018 ITR then you can get an EVL and provide current paystubs and indicate that income as your current income.

Thank you!! I was concerned that they think I’m still single. I feel better that it doesn’t effect how I file my taxes. I would prefer to file jointly for the benefit of green card interview.
