December 2018 AOS Filers [merged threads]

We finally had our interview yesterday in the Chicago Field office. per usual, you go through security similar to the airport, get ready to take off your shoes. we go upstairs 2nd floor to check in, the receptionist and guard were very friendly and joked with us when i didn't say good morning, trying to keep us relaxed a bit.

 

Our appointment was at 11:45, we arrive 11:30 and waiting until 12:30 to go in. so prepare to wait at  least an hour, we weren't sure if their lunch break was the reason of delay. there were multiple officers taking people in, i think i counted 5 or 6. ours was a young female, she was nice but still a bit stand-offish. We took our Oath, she took my hubby's fingerprints and both our IDs, his passport. first thing she asked about was his medical because it wasn't in the packet which i did submit. whatever i made her a copy of our original ones, she asked for the original, there goes that!! now I'm stuck with a copy which I hope it's not needed anymore.  She asked him to confirm his identity, Name, DOB, address, etc. then she asked both of us how we met and when we got married. when we moved in together, where we both work and what we do.

 

She then went through the yes/no questions, she randomly picked to ask him, like has he even been denied entry to US, ever been arrested, prostitution,etc...she asked if he ever been pulled over by police or got a ticket. at the time of filing we said no, but he got a speeding ticket in May and we paid it in June, she asked where he got pulled  over and who pulled him over, my husband didn't know the exact details, he just said near our home, then she asked if we paid it, he told her yes, she said that's all they care about. MAKE SURE YOU PAY your unpaid tickets before your interviews, if you have one.

 

At the end she said that was easy enough, right? we're like yes, all she said was give me all your proof of relationship, gave her utilities bills, bank joint account, joint tax returns, etc, and our wedding bill lol, also like 15 pics. she says she will review and we should hear something within 2 weeks(hopefully)

 

15 minutes and we were out the door. it wasn't grilling whatsoever, but I'm curious why some say they get approved on the spot while some have to wait.

 

you didnt have a lease or deed on both your names?

We had enough proof, all bills in both our names connected to the same address. bank joint account. Adding him to the deed is a process.  also i read a lot of people didn't add their spouse to the deed and they were approved.  honestly she didn't even ask about it, so im not worried too much. she seemed very laid back, definitely not prepared, it's as if she looked at our files, 10 minutes before calling us in.

Biometric NOA:  12/14/18  Biometric Appt: 12/26/18

Case is Ready to Be Scheduled for An Interview: 1/16/19

EAD/AP approval: 3/18/19

AOS Interview Appt: 6/4/19

AOS Interview: 7/10/19

AOS Approved: 7/23/19

GREEN CARD IN HAND: 7/26/19

Hello VJ fam, I have a quick question. My wife has her GC interview later this month. She came in with a K1 visa. Does she need to redo her medical physical with a civil surgeon or is she okay since she had it done last September at Ciudad Juarez? Also while looking thru all the paper work, all we have from the medical appointment in Juarez is her new vaccination record DS3025 and a Compact Disk with her chest x-ray. Nothing else was given back to her by the official during her appointment at the U.S. Consulate in Juarez

If you filed AOS within one year of her medical date and her DS3025 is complete, all you would need to have done is provide a photocopy of her DS3025 with her I485 application and then bring her copy to the interview. Her medical exam copy was in her K1 packet, collected at her POE and sent to DHS for storage in her A-file to be retrieved for the interview.

If you are concerned if her DS3025 is complete or not, you could post that here and I can confirm.

Thank you very much for this information! We should be fine then since we filed AOS December 2018. Since like you said her packet is sent to DHS from the POE and will be retrieved at the interview. We were afraid that maybe we didnt recieved other documents pertaining to the medical appointment in Juarez. We do have the original DS3025 and we did send it with our AOS packet. So all we need is to bring another copy to the interview. Thank you very much again! I will try an upload a copy

What does your status say for the I485?

Have you called USCIS and asked if your RFE has been processed and asked if your case has been sent to your local field office?

If it has then your EAD and AP should continue processing.

Sorry, the RFE was for I485 and it said like “I864 was not submitted by petitioner” 

Maybe because my husband’s sign was missed.

So I submit I864, certificates of employment from his new work place and stubs of 1month. 

 

I havent called yet yet so I don’t know what is going on but I requested from online.

You cannot request from online for your I485 as you are well within normal processing times. You will not get a response until you are outside of that timeline. You are only outside of normal processing times for EAD and AP.

You CAN however call USCIS and ask to speak to a Tier 2 and ask if your I485 RFE has been processed. Your RFE status would tell you that if you didnt receive a response from them about your RFE with 30 days then to call.

TBH I dont even think they received your RFE documents if nothing has been done by now. You would have received a notice, notification or a denial letter a long time ago.

My wife had her interview today, Buffalo NY field office. Went really well, took about 30 minutes. He basically went through the AOS application just asked her the questions from it. I think he asked me one question, what I work. He didn’t ask for any medical exam info. We didn’t have much in the way of supporting documents, my wife wasn’t able to get her SSN before her I94 expired so we don’t have joint financials. But he didn’t even ask to see them, at the end of the interview he just said if I have any documents I would like to submit he would take them. I had the purchase contract for a house we just bought in both our names, and vehicle insurance card with both our names, that’s all. We have a 3 month old baby we took along, she started getting fussy towards the end but he didn’t mind at all, in fact he was really friendly. He told us he will approve the case, and less than 30 mins after we left the office the status updates to “New card is being produced”. He had told us we’d get a notice of approval letter in 2 weeks, and the GC 2 weeks after that. Think we’ll get the GC sooner? Also, while we were in the office he checked on the status of my wife’s EAD and said it had not been touched yet. However, this afternoon (about 3 hours after the interview) the status of that also changed to “New card is being produced”. He said if we end up getting both to shred the combo card. 

 

Oh, December 21 was her NOA date.

I requested for EAD not I485. This is my status for I485. 

Since then, I didn’t get anything from them.

That's why you need to contact USCIS about your RFE for your I485. It's been too long. They usually give themselves 30 to 60 days to review the RFE documents and make a decision.

 

If they've made a decision in your favour, your case is likely at your LFO waiting an interview slot availability but then there is no reason your EAD and AP are being held up.

If they've issued you a second RFE, you might not even know because you may have missed the mailing and your status didnt update stating you received a second RFE. You need to call ASAP and find out about the I485.

After 197 days, my stepson's (@Bin'sAOS2018) EAD status on the old USCIS status website finally changed to "new card being produced."  The new website still says "case received."  I am assuming this will be a combo card and the AP status doesn't update.

 

Before this update, we contacted USCIS and spoke to a supervisor on Tuesday (July 9).  At that time, everything was still just processing.  He did note that my stepson qualified for an interview waiver because his mother and sister already have their green cards and local offices often skip interviews in situations like ours.  The final decision will be made by the local office (Baltimore), though.

I am not sure if our cases are similar. I am still hoping we do not receive an RFE.

So it's been 203 days since my PD and about 37 days since they got my RFIE. I just here to vent because I just lost out on a job offer due to this processing too way longer than first anticipated back in December 2018. 😢

So I contacted USCIS and got in touch with a tier 1. They basically told me there's nothing they can do until it hits the 60 day mark for the RFIE. 

Also, yesterday before my offer got rescinded, I got in touch with my senator's office. I filled in all the forms they requested and sent them back. Hopefully they can help push it along a bit although they make no promises obviously. I do hope I get an approval soon as we're pretty much at the end of our savings. Two more month of this and we'll be at risk of not being able to pay our mortgage and bills. 😫 Never in my worst nightmares did I expect to be out of work for 8+ months.
