December 2018 I-129F (K1) Filers

Hi! My fiance actually has not filed his taxes too since 2016 and 2017 because he was in college finishing his degree. Last December 4  he recently got a job earning above the poverty guidelines.

 

Is this gonna affect our application ? When we reach the interview process We are planning to show his pay stubs, cert of employment, W2 form and bank statements, do you guys think that would be enough?

I do not want to burst your bubble, but in America if you have a bf that did not file taxes for two years while he was in college...you will probably be denied on your K1 visa.  It is illegal in America to not file your taxes, and it does not matter that you were in college.  I filed my taxes all four years while I was in college, so being in college is not an excuse for not filing your taxes with the IRS.  I have read two reports on this December thread about two different bf that did not file there taxes and yet they are trying to bring their gf to America on a K1 visa, and I am thinking out loud that both of these folks are making big mistakes because the Embassy is not going to approve a K1 visa on a guy who has not been filing his taxes for two years.  You need to tactfully talk to your bf about filing and paying these back taxes if you want to have a K1 visa that gets approved.  I know this is not what you want to hear, but I am trying to give you good advise.

Not filing taxes will affect your K-1 because you can't show income to satisfy the consulate. If his employment letter and W2 show that he makes more then the poverty level there is a good chance he will pass. Depends on the adjudicator.

Will he have to provide a reason why he didn't pay taxes even if his friend is the co-sponsor? Will the Consulate want to have a reason why he didn't pay the taxes or will just having the co-sponsor's tax returns be all they need to see?

I dont think.this is entirely true...i have researched this...but what could happen is that if the person owes taxes ..they will deduct that from.the current income..

Overall...not filing taxes is not the smartest thing...we all have to do it and it will catch up to everyone eventually and it will be worse than it would have been 🤦🏾‍♀️

Your boyfriend is still the main sponsor. Yes, he'll have to explain why he was not required to file, or file if he was required to... How much money did he earn? Is he employed or self-employed?

And if he says that he never got around to filing taxes yet will they see that as a problem?
