So we were due to interview for October 10th of this year but it seems we missed the date.  We had called two times after October 10th to keep checking the status of our application and was said to keep waiting as they were delayed.

 

We had moved in March and I explicitly remember changing the address to where we currently reside. We have received correspondence relating to USCIS and it appeared to have been updated on the website. 

 

Only two weeks ago we received a document that was re-sent because it appears the address on file was updated incorrectly. The apt number was missing a number.  

 

It doesn't make sense how I was receiving mail from USCIS but did not receive the letter stating our interview date and when we spoke to two agents over the phone we were told to keep waiting instead of being told the date had passed. 

 

Now we received a letter stating my spouse has to leave in 33 days or else he will renounce to his rights of reapplying.  It also says we cannot appeal the decision but we can ask for reconsideration? 

 

What should be our next step??

Agreed with pushbrk, but I would also get an infopass appointment.  Take all the correspondence you have received to show where the address mistake happened.  Get on this right away!  Bringing it to someone's attention at your local will be a lot more helpful than thru the call center.  Start the process, but get the appointment, too.

Happens often, which is the reason I won't dare to move while having an active application. 😅

 

Seems quite common that the address never gets updated (even if you receive a receipt saying it was), or that the address only gets updated with the service center and not your local field office. Search and you will find countless of threads on this topic.

Is your spouse in the USA? If so what visa did they arrive on? If not was there an interview for the I-130?
