Seems 21 & 22 depends largely on the amount of evidence you possess to either prove the child would be in immediate danger with the father (which I haven't seen alluded to in this thread), prove that the father did not exercise his parental rights beforehand or gave consent beforehand (he did exercise his rights, and is not wanting to give consent), or that the child would be in clear physical and/or psychological danger if returned to the father (can this be proven?)

 

If you have strong evidence showing #21, then would seem you are in a better place.  If not, may want to consider consequences.

 

Perhaps you seem to think that #21 & #22 are there to protect a "good-faith abductor" (for lack of a better term)....21 & 22 protect the other parent as the onus is on the person who kidnapped the child to prove the child is better off with them, and that they kidnapped the child with just reason, and prove they are the better parent, and prove the other parent is a danger to the child----the other parent (the father, in this case) retains the luxury of being taken at their word and will not have to prove anything.
