Guys since I got my approval already me and my fiancé are starting to gather the documents for the affidavit of support but im confused with something and its the taxes information, in the instructions for the I-134 its says that the income tax report is just required when you are self employed but ive seen websites stating that even if you are not self employed you need to aubmit them.

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form K1/K2 Interview Preparation Instructions – English (February 2014)  Page 3 of 9 with an original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Get the IRS transcript in place of the actual 1040 here: https://www.irs.gov/Individuals/Get-Transcript

and my fiancé (the petitioner) moved to USA last year on December since she was living with me here in Dominican Republic, and she was here since she was 13 (she is a us born citizen) so we dont know how to proceed in that case as this is the first year she is going to file for taxes.

If this is the first year of filing, she is not going to be able to submit a 1040 or IRS transcript UNLESS she files prior to your interview then she can used 2018 taxes for the interview.

Hope this helps.

So lest say that she isn’t able to file before the interview, should i get something from the irs stating the reason why she hasn’t been able to file for taxes

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account: (1) Date account opened; (2) Total amount deposited for the past year; and (3) Present balance.

B. Statement(s) from your employer on business stationery showing: (1) Date and nature of employment; (2) Salary paid; and (3) Whether the position is temporary or permanent.

Those 2 are directly from the I-134. Make sure that she is able to prove enough income to meet the financial requirements. There are other ways to prove that the beneficiary will not become a public charge as well.

No. Your statement in font of the CO as to the reason why will suffice. Does she make enough with the new job that you are above the poverty level for your household size? If so then the employment letter should do the trick.

Then you are not going to have a problem without a 1040 but be sure she has an employment letter with all the "requirements" stated in the letter. Here is the letter. Just fill in the "blanks" with her information. And don't forget the other items in the "financials" that I posted earlier like w2's etc.

CO=Consular Officer (they are the ones that do the interviewing.) Assets must be considered liquid and will be 3X the requirement. Auto's don't count.

When searching that status of the NVC.  I noticed this message:

Please follow the instructions you received from the National Visa Center (NVC) that list the six steps you must take before NVC can schedule your visa interview appointment. This includes submitting to NVC various fees, forms and documents. Once NVC has received all the required items, they will let you know if anything is missing or incomplete. You can also find these instructions online at http://nvc.state.gov (English) and http://nvc.state.gov/espanol (Spanish). You will find contact information for NVC at http://nvc.state.gov/ask.

What NVC fees, forms, and documents is it talking about?  I didn't think I sent anything to NVC.  I thought I send it to my fiance and takes all the paper to the embassy?

Well, that question of yours has been asked a hundred times. Since you are a K-1 and your Embassy does your interview, and matter of  course you pay your fees according to their instructions, this is something that you ignore. Once you have your case number you are no longer responsible to NVC.
