Well there is a couple of things you may be able to do.

 

1. Can you file the missing tax years and would the income there be enough to satisfy the income required for the I-129f?

2. Can you find a new job that you can present to the embassy your new salary in a form of a employment letter or even an offer letter may work.

3. Do you have parents or siblings willing to help you out?

Hi everyone! I created this post in the Argentinian´s group in Visa Journey, but wanted also to share it here as well.  Hope this could help as a guidance for the ones prepairing their packet 3 for the interview. Please have in mind the information added is what the US Embassy requires in Argentina, but in general it may help you to organise your own paper work, mostly if you are doing it by yourself with no immigrant lawers involved, or if you do, just to check if you have information missing on your paclet 3 before sending it out to the embassy. Good luck to everyone! and hope this helps 😃

1) K1/K3 VISA APPLICATION INSTRUCTIONS, signed. 
2) Cover Letter with table of contents (This is just the same thing you did on I129F petition packet, to let them know what information they will find on the packet)

3)  BENEFICIARY DOCUMENTS:
A) CSC MRV Receipt. 
(Also added a copy of the confirmation email of MRV Payment)
B) DS-160 CONFIRMATION
C) BIRTH CERTIFICATE copy 
(Mine is translated and appostile, because we sent a copy to the USCIS in the I129F Petition, if you don´t have it translated or appostile for packet3 it is ok, you only need to translate documents if they are in another lenguage that is not English or Spanish, but have in mind that to do AOS in the States, you will need to send a copy of the birth certificate and that one must be translated and appostile to be valid overseas)
D) PASSPORT BIO PAGE copy
E) POLICE CLEARANCE from RNR with expetion of ART 51 of the constitution copy.  (
This exception means you give total permition to the US goverment to call the Registro Nacional de Reincidencia and investigate if you have any police record of jail, If you´d been judged during the last 10 years or any problem with justice. This is what the RNR rep explained to me) 
F) CERTIFICATE OF NO PREVIOUS MARRIAGE copy. (This is not a MUST, not included in the k1- k3 original instructions, but my fiance and I decided we wanted to show them by a legal paper that we never been married before) 
G) MEDICAL EXAM PICTURE OF CLOSED ENVELOPE (This is to show proof you did your medical exam. In my case, Dr Grillo sent the envelope to the embassy, because the results weren´t ready when I returned to the Trinidad de Palermo. So the embassy sent me an email they received the closed envelope, so I printed out the email and added as a proof I did my medical examination)
H) 2 PASSPORT PICTURES.

For example: We sent the I129F packet in June, so we added communications until May 2018, so for the Packet 3 we added our communications since last weeks of May 2018 until present.)
A) WHATS APP FACETIME CALLS SCREENSHOTS.
B) WHATS APP CALLLOGS SCHREENSHOTS.
C) WHATS APP CHATS

D) ADDITIONAL CONVERSATIONS WITH MY FIANCE´S FAMILY MMEMBERS, AND MY FIANCE HAVING CONVERSATIONS WITH MY FAMILY MEMBERS. (This is not a MUST, but as we added this information in the original I129F packet, we decided to show them we continue having a strong bond with eachother´s family members) 
E) FACEBOOK POSTS (We use social media preaty much, so in I129F packet we added facebook posts, to show our relationship is not a secret, and that friends and family know and participate, so we did in the packet 3 as well. This is not a MUST, to add as a proof)

F)  PRESENTS TO ONE ANOTHER:  This is not a MUST, but my fiance sent me a present for my birthday so we added pictures and the currier papers to show proof and also other presents he brought to Mexico when we met in person last year.

G) WEDDING PLANS: We added emails talking about the wedding plans in the US, pictures of the wedding rings we bought in Argentina when we got engaged, and all the wedding plans you may have. 

I kept originals in another binder organised just like all this copies for packet3. I know we added a lot of information, but we just did our packet based in what we did on the I129F original packet. We did not hire any lawers and got approved, so hope we will have luck this time. 

Also as I said, hope this helps all of you as an example of how to assemble the information. There is no specific way  to assemble the packet, so remember to try to add all the proof you may have and all the documents required by the embassy in your country, and all the paperwork that apply to your specific case. Then have the originals at the interview, if they don´t ask you for any originals, fine, but you are ready just in case. 😃

is Argentinian Embassy a „hard” one? :) That is a lot of ongoing relationship proofs.

It means that you will not have a complete picture of the status of your path to visa issuance because the "immigrant" select is going to go "dark" with no updates because your visa is now being processed as a "non-immigrant" visa with immigration intent. As a K1, when checking your case online at CEAC.state.gov you have to select "immigrant visa" as it is treated like as such even though it is a "non-immigrant visa".

 

Technically the K-1 is a non-immigrant visa but it is treated like an immigrant visa because of the AOS. It is kind of a ba$tard. Other non-immigrant visas do not usually end up with green cards!  The K-1 on its own is a single entry, short time limit visa that expires 90 days after POE. That is why it is a non-immigrant visa treated like an immigrant visa because of the immigrant intent. 

 

If your having problems with the CEAC site timing out when looking up your case it's because the system is trying to cross reference the immigrant case number with the non immigrant AA number.  You select Non-Immigrant from the drop down menu and select the proper Embassy location. Then you enter the AA number from your DS-160 number and presto...a much quicker and consistent response. The output is the same but you no longer have the problem with the system timing out while doing the search...

Just about everyone goes through this process after their interview.  Based on the discussions I had with the case officer he informed me of the steps that the Embassy takes to complete the processing of your visa:

 

the first AP is the immigration unit doing the paperwork for approving the visa

the first ready is a notice that they are finished and the paperwork is being sent for visa issuance

the second AP is the visa issuance people doing their own paperwork

the second ready is that the visa has been issued and is currently being processed for delivery

 

Then "issue" is posted and the visa has left the BIG house to YOUR house.

 

Once you get that second ready, it should be sent out within a few days.

Hey guys! We can't find substantial information on requirements for certified translation of a no criminal record if it is from abroad (Ecuador). Would a translation and affidavit from a translator from the US be okay, or would it need to be from Ecuador?

It can come from any translator who will certify the documents are true once they finish the translation.

Then it's mirroring exactly what I penned not 3 or 4 post ago. Yours is normal and processing as it should. Trust the process and you won't worry so much.

Green Card Approved July 11, 2014 Approved, no interview. Went to card production.

Green Card received July 17, 2014 GC received without interview

Sorry to keep heckling 😕 but does this need to be notarized too? Or just their affidavit, stamp and signature will do?
