Hi everyone, I was misinformed that a fee waiver was applicable for I129f which I filed last week. I was informed by USCIS this morning it does not apply for filing the K1 visa petition, I’m certain my petition will be rejected and returned due to non payment. When my packet is returned and I send payment will this start the wait time from last week when I filed or proceed within the new time frame after payment is received?

New time frame. Once petition is rejected you start all over again.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Can you please be more specific? By who or where were you misinformed? This would help some people on here to make sure to avoid certain sources of information.

 

I personally never herd that you can waive a fee for I-129f. It makes sense that I-129f can not be waived because we have to submit Affidavit of Support form. And if we don't make certain money its almost impossible to get it approved. So I am sure that government thinks that if we can support our future wife/husband than we should support government and pay the fee. But it sure would be nice to not pay that fee of over $500.00 dollars. 

 

At least its nice that USCIS sends notice of that and have you resubmit the fee and you don't have to wait till NOA2 to find out that you didn't pay the money and get declined or lose 6 months of waiting.

I contacted USCIS customer service, prior to filing the petition and was misinformed by a service agent that the waiver was applicable. I contacted the office again for clarification after filing and was told this is not true and that unfortunately the previous agent misinformed me.

Possibly the officer thought you were married. You aren't married right?

Fee waiver under what grounds, low income?  If so, how will you support your beneficiary?

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

No fee waiver exists in those cases, so I would also not suggest anybody to file for one under those circumstances. :P

 

A fee waiver for several other processes is possible...just not family-based immigration.
