Hi u all!!!!

I have a cuestion..... We are in the k1 process. We recieve the NOA2... I used to work in Puerto Rico but after a while we decide to live together in Argentina, of curse I had to leave temporarly my job. Well my cuestion is.... I never did any tax return... I'm planing to get back to work this month... I have my accounts statements and my salary back but no tax returns..... I make around $1,000 a month... My mother's salary is around $2,000 per month.....Can my mother be the sponsor even if she had 3 dependants???

Are you a US Citizen? If so, you are required to file tax returns even when you have worked outside of the US.

If your consulate requires tax returns, you need to provide them. You will also need to provide them down the road at AOS.

For sponsor information, read the instructions for sponsors, poverty guidelines and household size on the USCIS website.

Exactly..Its very important to file your returns, whatever be your income.

My husband also had not filed his returns for around two year but he got it done now since without it I cant go ahead with my AOS filing.

You can give a call to the IRS and let them know that you want to file your returns for the number of years you have'nt. Infact they have the record of all your W2s and other details. They will mail across those details with which you can either approach a tax consultant or get it done online. Best is if you know someone who can do it for a nominal cost.

There would be penalties involved as late charges and interest but better late then never..

You cannot avoid it either ways..

Regarding your mother being a sponsor, my idea is she can go ahead with it..But wait for others to suggest on this as well since i am not very sure..

Well I am an american citizen but I'm from Puerto Rico, so I don't have to file an IRS Tax return.

I think I'm goin to file a Puertorrican tax return and then file the sponsor's documents with my mom as a co-sponsor.

If your consulate requires tax returns as part of the affidavit of support, yes, you will be delayed until you provide them.

Which Returns To File

Generally, you will file returns with both Puerto Rico and the United States. The income reported on each return depends on your residency status in Puerto Rico.

I am not sure at which stage of your processing you are right now.

Is your K1 approved?

Well, at whatever stage you are, filing of taxes is essentially required all along.

If you get thru k1 without having filed your taxes, it would be required again at the time of AOS filing.

If you are still doing your K1, the I134, affidavit of support requires your tax return for the most recent year, you have to get it done before the visa interview...otherwise rescheduling your interview date can delay the process hugely.

Also later at the time of filing the AOS, The I 864 (affidavit of support) which you need to submit along with your I 485 (AOS) requires your tax return for the most recent taxable year. But lot of people get an RFE where the USCIS have asked for previous years as well...so its better to have your returns for 3 yrs.

I gave your general information, not sure abt the rules taht will apply to you since you are from puerto rico

Well we recieve the NOA2.... Of course means that our interview is close... maybe some months away...

I just figure wat i'm going to do... I'm filling my tax returns papers this week in the mean time i'm going to gather all the oder information about, bank statements, etc..... So we'll have this info and in a month aprox. I'll have my tax returns copies...
