So we just got the EAD today in the mail. I'm gonna go down to the SS Office on Monday and apply for the number, but what exactly do I need to take? The instructions on the SS-5 say that I need a birth cert or passport, ect, but is that really necessary? Can I just take the EAD down there and that will be enough? Or do I actually have to take the foreign birth cert translated, foreign passport, certified copy of marriage license and all of that? Or just the EAD?

Also, my wife can start working on Tuesday with just the receipt saying that a SS# has been applied for and is pending right? Its my understanding that its not necessary to wait the 2 weeks or whatever it takes to actually received the number and card in the mail, right?

Yes.

Can I just take the EAD down there and that will be enough?

No.

Absolutely.

Technically, they will assign the number to you in a couple of days, so you can call them and ask what your number is. But I doubt it that an employer will hire you without seeing the actual card. You will need to wait.

Yes you need to take proof of who you are... so passport is the best... I think I had to show my Birth Certificate as well as my passport... your ead, marriage certificate if you want her name as it is married. They may not have her name in the system yet... but you can sure hope. You can get your SSN usually within 48 hours of SSA verifying your name. As I understand it you should have 90 days to show your employer your actual documents after you've showed them your confirmation from SSA.

Let me just add this information I found... Not too sure if it's applies... I'm sure someone will correct me if necessary....

SECTION 1: EMPLOYEE INFORMATION AND VERIFICATION

Responsibility of the Employer

Employers must ensure that Section 1 is completed by the employee upon date of hire (i.e. 1st day of paid work). The signature and attestation under penalty of perjury portions of Section 1 are very important, and employers should take special care to ensure that employees complete these in full. Although employers are held responsible for deficiencies of information in Section 1 (i.e. where required information is not provided by the employee), they may not require employees to produce documents to verify Section 1 information.

NOTE: An employee’s signature and attestation of status under penalty of perjury are particularly important. If a given employee refuses to provide his/her signature or attestation, there is no reason for the employer to proceed to complete Section 2, and the employer should not continue to employ the individual.

NOTE: An employee is not required to include his or her social security number in Section 1 of the Form I-9, nor can the employee be required to do so by the employer. This information block is optional. However, there is one exception: when the employee is hired by an employer participating in the voluntary automated employment eligibility confirmation pilot program.

Yes. An EAD card alone satisfies the I-9 requirement, so one should be able to present the EAD at the time of hire and simply write the SSN on the forms without showing the SS card to anyone.

I think the only problem may be that many HR people believe they are required to SEE the card. I would print out StormnRolly's post (including the URL where it came from) just in case your wife's employer gives her a hard time.

These seem to say that you can use the receipt you get as proof that a number for you is pending, and can start to work immediately, before you actually have the card or the number.....

Right - but many employers don't know this so best to be prepared and have that information printed out and available.

Original or certified copy is the same difference. They may photocopy the document but they definatly don't keep it.
