What visa did you apply for? Fiance or spousal? You would not be eligible for a 129 Fiance visa if married

 

Sorry unaware k3 was still issued

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

I agree with everyone. I also applied for K3 but it was denied. But I didn’t submit i130 AND i129f (k3) at the same time. I applied i130 first and then waited for noa1, then together with noa1, I applied k3, but then again, it got denied.

Wait for the I-130 to process. Do you have a receipt number for the I-130? If not, was the I-130 check cashed?

you need to call and see if there is a receipt number. thats the first thing. from there, you can know if they received it at all and if they did, what the status is.

 

did you send it with tracking? How did you submit payment? Was it cashed?

 

When you resubmit, submit the correct form for your situation and send it with tracking so you know when it was received.

you applied spouse visa CR1 as your case is in Nebraska

If the check was sent,  (and what they say is working on case) you just wait

our Nebraska case was there 10 months and then sent to Missouri for faster processing / it took another 5 months

so, sorry, but just wait

and your congressman can not help/ if u ask, they just inquiry and get answers u get

incha allha you will hear soon

but this is Nebraska and very slow to process

what we must to do with it now and how much more months we have to wait and it have been one year now

Just to clear up some confusion about the K3 category. Although it is obsolete, couples can technically still apply for it. They do so by filing the I-129 and I-130 simultaneously.

 

The problem is that K3's are rarely approved (less than 1% of marriage based visas were K3s last year). So what usually happens is the K3 is denied and the case is converted/moved to a CR1.

It's not "denied" or "converted" it is administratively closed and the I-130 that was filed continues as a standalone culminating in a CR-1 visa (or IR-1 as appropriate).

As stated above, this will almost certainly become a CR-1 case.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
