Affidavit of support: Temporary job?

My girlfriend currently works for IRS, but it's only a temporary position until November. She however meets the 125% minimum (only slightly higher than that). In a few weeks she's going to have to get these documents ready and signed in presence of a notary so she can send it to me for my interview. The question is, will it be a problem since it's only a temporary position, or will it do even for AOS (which we plan to file for in September/October, depending on when we can get married)?

She's going to have around $6000 on her savings account (and no debts whatsoever), so maybe that helps? Also I could wire her some of my money (around $5000) (I will have to transfer it sooner or later either way) to her account, but the question is if that'd count... Or should we really search for a Co-Sponsor, which might be not that easy and I think she wouldn't want to do that in any case.

If your going to just use assets, you need to have about $50,000 to support two people. Anything less though can be annualized to to supplement your income.

Could please expand a little, as I'm not clear. Just using assets (what else would one use?), you're saying that the petitioner needs to have about $50K to support two people.

Do you mean $50K annual salary or $50K in savings? And last question - where does that figure come from? It's so much higher than the $16K required income.

Thanks much!

Assets can be anything that can be easily liquidated to cash. Mainly, these would be savings bonds, stocks/bonds etc. I think that it can also mean less liquid items like vehicles, appliances etc.

In savings or anything liquid like stocks and bonds. I dont think I would count a car since it depreciates pretty quickly. The figure comes from taking $16000 x 3. Well the actual number is 48,000 but its better to be just a bit over rather than right on the limit.

If you have less than that, say $10000, you can take $10000/3 and that would make up for a shortfall of $3333 in income.

Really sorry, I'm not clear about which contingent this advice is most relevant. The example applies to those who earn +/- $16K/year (?). And for those who earn $50K in annual salary, then it's a non-issue. (?)

In once instance the person is using assets to quailify. A salary is not an asset. Money in the bank, bonds, stocks, equity in a home, business, anything that is easily liquid (able to be turned to cash) is an asset.

In the other instance you use your salary to qualify.

One is 50K

One is 16K.

Assets are not income (in this instance).

What did she make last year - over the minimum required? If she did, then you are likely OK.

She didn't really make money until this year because she was going to university. I guess we're in trouble :(

When I sent my fiance my I-134, I had been working for a temp agency for a year (making barely over the 125% requirement). The agency wrote a letter mentioning it was a "long-term temp assignment". I had no savings or any other assets. We got approved fine. (My 2006 tax return showed I had earned the 125% during that year, though the earnings were all through several different temp assignments.)

They are mainly interested in current income that fulfills requirements, but I would really suggest a serious search for a co-sponsor just in case.
