Hello, I am having difficulty with some parts of the I-130. Please assist?

 

Question 53. Was the beneficiary EVER in immigration proceedings?  Yes/No

 

54. If YES, select type of proceedings:

__Removal      __Exclusion/Deportation 

__Rescission  __other Judicial proceedings

 

 My husband never appeared before a judge but was taken by border patrols and released to Tijuana

 

Also, My lawyer from years ago when I first filed petition for my husband( we did not continue the process and withdrew) the lawyer put “ Removal” to the old I-130 version but answered “Unsure” to immigration proceedings question. 

 

Im not sure if answering NO to 53 then Removal on 54 would make senseor will confuse immigration officers?

Removal sounds correct to me, based on your description and the lawyer's previous opinion.
