Hi there.. i am going to file fiance visa for my fiance.. and i have 1 question.. she is previously divorced.. but she applied for visitors visa to USA 1 time after her divorced. And agent who makes paper for her put her status as single instead of divorce.. so now we are confused if we should attached divorced papers with our fiance petition or not.. or should we leave status as single. Please help.

The I-129f petition clearly asks about previous marriages.

As said, the 129f asks about previous marriages. Enclose a copy of the certified divorce decree

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

I know it metion in instruction.. but she was scared if immigration going to called this fraud.. because on her vistor visa her agent mention her satus single.. or is that no problem. Thats all i wanted to know.. if No matter what status they put on vistor visa.. we still have to attach divorce decree?

She should submit the divorce decree regardless to what was written in her visitor's visa application. You should never lie to immigration officials.

Yes, you must attach her divorce decree.   If you do not, it will delay your process.  No one can really know what impact the lie on the visitor visa form will have.  Did she receive that visa?

Well then, that shouldn’t become a problem. Put divorced on the petition and include her divorce decree. If they question you guys later, it will be easy to explain what happen. Good luck!  We are here to help you on your journey. A lot of good folks here!

Compounding one fraud with another isn't going to help.
