Hi,

 

I have a few  questions.

 

When adjusting status from a tourist visa can you file I-765 and I-131 at the same time as the other documentation? 

 

Should the beneficiary plan to remain in the U.S. the entire time the AOS is being adjudicated?  Or do they approve I-131's and allow for travel?

 

What is the current wait time to get AOS adjudicated for a parent from a B2 visa?

yes.

 

you must remain until complete until AOS is completed or your AP is granted (yes you can file for AP and EAD)

 

I don't think AOS time lines are any different for the various visa types. So 8-10 months to completion, maybe sooner depending on your service center

 

im relatively confident in my answers on this, assuming it is the same as a spouse adjusting from a tourist visa. if its not then.... ?? lol

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

from my understanding and I could also be wrong but its anywhere from 11-24 months.

Visa type doesn't affect AoS. ALL AoS applications, whether from a student, tourist or work visa or K1, get lumped together and adjudicated by your local field office. Check USCIS processing times for yours on the website. Expect to wait about a year. Less if you get lucky. No way to know in advance how long your individual case will take. It happens as it happens.
