Greetings everyone! I met my fiancé in Thailand 2 months ago, however he is from Africa. He has been on a work Visa for the last 11 years In Thailand. Is it too soon for us to apply for the K1 Visa, and will we he be able to work through the process from Thailand? Thank you

Meeting someone once, on vacation, does not love make. lust and infatuation, perhaps, but not love.

 

technically, yes you can apply for the k1 now. realistically, you dont know the person.

If asked now, I would probably agree because people tend to become cautious with age. But at 27, I met my ex, decided it was serious on the first date, he moved in with me in a week, married in 5 months, had kids, after 17 years agreed that marriage has failed, separated and got final divorce decree after 19. We met not on vacation but through our jobs. Does it really matter? Hardly. Was it merely lust and infatuation? Don't think so. It wasn't an international or long distance relationship though.

 

K1 visa is a derivative from a relationship, if it is viable, everything is doable. People tend to pay more attention to formal issues of K1 process and known red flags but hardly ever consider why COs tend to be preoccupied with them. However, IMO red flags are more important for the couple themselves, because they can really spoil the best of relationships. If red flags (including short courtship) are duly addressed in terms of K1, moving and adjusting the status (not buying property, not having kids right after marriage, having sufficient funds to support the beneficiary up to EAD, beneficiary willing and able to find a decent job etc),  if the couple know what they are doing and why, they will be fine.

Overall I agree with Roel.

 

Personal opinion: Yes, you can fall in love at first sight and have a long lasting relationship. Do I think its wise? No. Odds are against you. Relationships have a honeymoon period and you are smack in the middle of it. Let things cool down first and see whether his nose picking starts to bother you. 

 

Legally: Yes, you can file while he is in Thailand. He will go through the embassy there.

Depending on how tough the embassy is (depends on the country and level of fraud from that country) they will scrutinize your relationship. (Look around on the forums about thai embassy) The more red flags there are (short relationship, age difference, religious background difference ect) the more they will pick your case apart and the stronger your evidence needs to be. As Roel said, theres just not much evidence to prove a relationship just yet.

 

Not sure if you asked if you can stay with him during the process, somehow I read that in your post, might be wrong though. But you can't viably stay with him through the process as you will have to prove income to support him. If you live with him in Thailand I suggest marrying and filing a CR1.
