Unfortunately it is part of the process with the K-1 and something that really needed to be better understood and evaluated before hand. We won't go back for him to see family until April next year, and be 2 1/2 years by then, but we work a lot so partially because of that and his vacation time options but. Definately still may get your AP in time but cutting it close, plus then the late travel costs with holidays... but maybe.

I’m going to try for the emergency AP and fly over there the first chance I get.

If you go to a USCIS office, maybe you can go for Christmas....Have you previously applied for advance parole?

Have you filed your I-485, I-131, and I-765 yet?

I think that is the bigger question that has yet to be answered.

I was under the impression there had to be a death or something like that to be granted emergency AP...would my grandfather just being ill be enough?

Apply for Emergency AP. It is free (don't forget to include the NOA1 from your I-485 form). You have three weeks left, though with the holidays?

Can your family make it to a border town and meet them on the US side? eg Bellingham WA, Buffalo NY, Lake Champlain NY? Etc?

I feel for you, and wish you the best. As I type this I am at a ice cream shop with my fiancee visiting her friends before she leaves with me tomorrow to move to the United States. We visited her family all over the country these past few weeks, and I keep telling her it is going to be tough, but she insists she is ready and as long as I am with her she will be fine. I hope so because I worry so much she will be in the same situation. I have her enrolled in school for advanced English, and many other things I hope to keep her busy with. I had internet installed at her mom's house so she can video chat with most of her family anytime she wants.  Good luck to you, and I hope for the best. Try for the emergency AP, like everyone said, isn't going to hurt to try.

That's so awesome that you have all that stuff lined up for your fiancee when she moves. Making effort like that can really contribute to making her feel welcome and settled faster. I feel homesick as hell, but then, nothing was set up for me. If it had been then I may feel different.

Personally I think it's a huge factor in getting settled!

Personally, I don't think I would try to get emergency advance parole if my I-94 had expired and I had not filed for AOS...

The most common excuse is that  they don't have the disposable income to file AOS since the immigrant can't work.

That excuse is even less valid now; USCIS accepts credit cards: https://www.uscis.gov/news/news-releases/uscis-expands-credit-card-payment-option-fees

Nothing to expedite.

Not a question, just need a place to sort of vent where people might understand what I’m going through.

Not being able to go home for Christmas is absolutely crushing me. I don’t have advance parole and I was really hoping to have been able to see my family at Christmastime. I’m very very close to my family, so this will be a first for me. Not to mention my grandpa who has been a father figure to me, is ill, and the thought of not being there and this being his last Christmas terrifies me and just makes me emotional whenever I think about it.

Christmas is my favourite time of year, so I’m trying not to dread it or anything. After living somewhere I don’t know anyone, not being able to work, and not being able to go anywhere to meet new friends or anything...I just wanted to spend one week at home, with my family, you know? They don’t make this process easy on the immigrant at all.

I feel your pain,

it was hard for me to not see my family on special occasions as I am close to my family as well, even while doing the ROC is hard cause I cant go see my family cuz now my GC is expired an have to wait for my NOA1 to come in to go see them n I am not sure if it will be here my Christmas.

in this situation I just facetime my family as much as possible and I bough my moms ticket twice to come stay with me for abit, it may not seem a lot but we have to do what we have to do to stay with the people that we love and wanna have a family of our own with.

Perhaps once your AP comes through you could go home and have a Christmas part two. Let’s face it, Christmas is an amazing time of the year and who wouldn’t want to celebrate it again! You and your family could still exchange gifts, have the meal, heck you could even put the tree up again.

Going through this sucks (before I had my K1 I had a work visa for US and missed a lot of things). Me and my family just re-celebrate things such as Birthdays when we see each other. You can even make that a new family tradition.

Hang on in there, for all the bad days, there’s many more good days ♥️

Oh this story just touches my heart. I’ve been here 5 weeks and just filed AOS the other day. Feel like I have been here 6 months. I don’t regret doing the K1 and would totally do it again.

I was so upset the other day as I had my life in the UK, my routine and my Management job. Now it’s all so different. Vegas is constantly buzzing and I’m from a little rural town in NI. Jake sat me down explaining that the beauty of the K1 is it gives you time to adjust to a new country and learning to drive on top of other things. I see what he means. I know I have to wait 5-6 months for EAD etc but I’ll feel so ready to work and I’m aiming to have my licence by then to drive around Vegas.

Good luck but I’m sure so many people can relate to you ❤️

I'm not really sure how that would be any different than a CR1 in that regard, except that someone with a CR1 is immediately given a lot more rights.

Issues with getting a DL is a major negative on a K1, at the time IO did mone I was able to get an EAD in time but my State has tightened up driving privileges and of course EAD takes a lot longer.

Well, I would assume that someone on a CR-1 wouldn’t want to wait 5-6 months to work when the benefit is already given. But I guess that may happen too. It’s all down to perspective and individuals.
