Applied I-130 for my wife a week a go, now I want to apply form my Dad

Please help,

I just applied for my wife using the I-130 a week a go, I haven’t received anything yet,

Now I have thought to apply for my Dad, (my brother is applying for my mother), would that be possible? and if yes, is it going to slow my wife’s visa process?

Any help is appreciated

I'm not an expert, but the proposed changed in the visa laws would make applying for your dad out of the question altogether ... so I'd recommend applying for your dad's visa sooner rather than later. I don't imagine that it would slow down your wife's petition at all, but maybe some wiser heads have something else to say.

7-20 informed that she has cleared medical. Documents not yet forwarded to Embassy, they will not release them to her, saying they must deliver the documents themselves. (Not true. many people had their medical papers @ the interview)

7-21 Missed flight

7-25 Docs recieved by embassy, visa all ready to go

7-27 Visa revieved

7-28 ARRIVED IN USA!! :D:D:D:D:D:D:D:D

I read on the General Immigration posting (look under "News") that the bill would still allow USC to sponsor their parents but not their siblings...

Please help,

i don't see any reason for u to not apply for ur dad while ur spouse's petition is pending. By the time ur dad will need an affidavit of support..ur spouse should be here cause the parent petition takes longer to process.

also where did u access the information on the new bill that can stop people from bringing their parents over..just curious.

There doesn't appear to be a good reason why you cannot apply for both now and sooner is better than later based on what may be on the horizon for visas for parents of USCs. Keep in mind that you will have to meet the financial support requirements.

In Place Of The Current System Where Nearly Two-Thirds Of Green Cards Are Awarded To Relatives Of U.S. Citizens, Our Immigration System Will Be Reformed To Better Balance The Importance Of Family Connections With The Economic Needs Of Our Country.

Visas for parents of U.S. citizens are capped, while green cards for the siblings and adult children of U.S. citizens and green card holders are eliminated.

A new Parents Visitor visa is created to ensure that parents are allowed to visit their children in the United States regularly and for extended periods of time.

The Diversity Lottery Program, which grants 50,000 green cards per year through random chance, is ended.

These rebalanced green cards are used to clear the Family Backlog in eight years and then applied to the new Merit System for future immigration once the backlog is cleared.

I hope this bill doesn't turn into a law.. because it would be on the grounds of discrimination to grant visas to individuals who speak only fluent english. also it would be really unethical to separate parents from their children, especially for collectivist cultures where adult children take care of their aging parents. hopefully democratic party comes into power and helps stop this bill in its initial stages. :dance:

All the more reason to file now, before the law can go into effect. Your plan is a good one. Go with it.

Let's drop the political part of the discussion but really, this proposed law doesn't separate parents from their children. It allows for frequent and extended visits. Sons and daughters will need to carefully consider immigrating, if they expect to care for their parents. What would be terribly unfair and unreasonable, IMO, is for a son or daughter to expect their parents to leave their home country and follow them to the USA as the only way for them to survive their golden years. There's at least two sides to that particular coin. :yes:

Its a political issue so can't leave politics out of it. Ok..agreed that it doesn't really separate parents from the children. But it is so determental for families to rely on the immigration defintion of "frequent and extended visits" I think you have to belong to a collectivist culture to understand the impact of this issue.

We can discuss a law while leaving partisan politics out of the discussion. I think I have more than a clue about the potential impact. After all, my wife comes from a collectivist culture if there is one anywhere. Had she been the only child, she would never have considered leaving China. She already cared for her mother through her final years and brought her father to live in her home after his wife's death. Now the younger sister has moved into my wife's home to care for the father and her brother helps as needed. It doesn't matter whether this law changes. Her father would never leave China, and would have an extremely slim chance of obtaining a visa to visit the USA if he wanted to. You see, by your definition of "descrimination" we descriminate against former Generals in the Communist Chinese Army, even ones that retired 20 years ago.

You speak of a potential impact and additional considerations that would result from such a law, if enacted. I don't see it as discrimination. Laws change for many reasons. The rest of the world's people don't have rights to live in the USA. US citizens have rights to bring some family members to the US if doing so complies with current law. Disagreement with a law or "inconvenience" or "not getting what we want" don't meet the definition of descrimitation.
