Hi. I recently filed for my husband under Formi-130. I am a permanent resident and i received a NOA and the priority date is the current date. What does it mean? I’ve read some forums and it says there is already a visa available for him but I am not really sure

In order to get past NVC and get an interview:

1) The I-130 needs to be approved.

2) The Priority Date (PD) must be current on the visa bulletin. For F2A, there is about a 2 year wait.

"Current' means the PD is on our before the Final Action Date in the visa belletin. https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html

When you say the priority date is the current date, do you mean it is the date actually as it is now, or the date that is listed as “current” in the visa bulletin?  If you filed recently I’m guessing it’s the former. The “ current” priority date for F2A in the latest visa bulletin is 8 Oct 2016, see first table https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2019/visa-bulletin-for-december-2018.html. Only when the date in the visa bulletin for F2A is the same as your priority date, will there be a visa available for your husband.

Dates for Filing - this is a table of PDs for when NVC will accept forms. But they still won't proceed past NVC until the PD is current on the first table (Final Action Dates).

That’s why I told you to look at the first table, so you wouldn’t get confused by stuff that is not relevant to you now....

Thank you so much for your kind explanation 🙂 are you waiting for your priority date to be current too? What is your service center?

I'm a USC and did a K-1 (fiance/fiancee) visa for my now-wife, which effectively doesn't have PDs.

I'm assuming your case is at CSC (California)....that tends to be where they process F2A cases.

Yes, we applied on July 2017. They are processing Nov 2016 as of now. Hopefully next year we get an approval.
