what's the average wait to get NOA1 notice?

Hello everybody,

How long should I wait for the USCIS to open and process my I-129F which i sent out on April 30, 2007 and they did receive the mail on May 2, 2007 as I checked from my USPS online confirmation...

I filed on CSC at Laguna Niguel, CA region and lived at San Jose, CA currently.

I read the forums and seems to me, it took about 1-2 weeks but it's been more than 2 weeks now and i still have not receive the NOA1 snail mail yet. I checked my online bank account daily and i haven't seen the USCIS cashed the money yet.

any idea/suggestions that I could do from my side?

Normally its a week or two before you will receive the NOA1. But right now with the H1B visa applications they are backlogged. if you dont recieve it in a couple more weeks, then call the service center and see if they have your case.

Ours was received on 25th April but our cheque hasn't been cashed yet either.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

H-1B cap for 2008 reached in record time

In less than two days, the U.S. Citizenship and Immigration Services received 150,000 applications for 65,000 slots

Employers looking to keep skilled foreign workers on staff in 2008 this week rushed to file some 150,000 petitions with the U.S. agency doling out 65,000 H-1B visas.

Yet the U.S. Citizen and Immigration Service announced this week it had reached its limit for 2008 H-1B visa petitions within a day of the set deadline. The government agency reported it had received about 150,000 applications for 65,000 slots by Monday afternoon and that it would not review petitions received after April 3. In fact, all petitions received on or after April 4 will be immediately rejected.

According to the USCIS, the Immigration Act of 1990 H-1B nonimmigrant visa category lets U.S. employers augment the existing labor force with highly skilled temporary workers. H-1B workers are admitted to the United States for an initial period of three years, which may be extended for an additional three years.

The much-sought-after H-1B visa helps U.S. employers keep foreign citizens in specialty occupations, including architects, engineers, computer programmers, accountants, doctors and college professors, among other professions.

Technology companies in particular look to increase the cap to double its current limit. For instance, the Information Technology Industry Council (ITIC), whose backers include Apple, Dell, eBay and Intel, last year asked that the cap be raised to 115,000.

As for available 2008 H-1B visas, the USCIS will subject the petitions received on April 2 and April 3 to a computer-generated random-selection process, according to an agency press release. The agency does not expect to conduct the random selection for several weeks, considering the high volume of filings.

All petitions not randomly selected by the USCIS will be returned to the applicants and are eligible to be resubmitted on April 1, 2008, when another lot of H-1B visas become available for fiscal 2009.

It's pretty amazing and i guess the immigration officers on both 4 main offices (CSC, TSC, NSC, VSC) are overwhelmed with the H1B visa requests. Thank you RosemarieL for the info. I do hope that the USCIS will cash the check pretty soon so even if the NOA1 snail mail has not arrived yet, we can safely assume that the I-129F mail has been opened at the very least.

Yes, I would give them a call. The H1-B craze may be dying down a little as the USCIS said in a press release that everything will settle by June. Not sure if it's effecting April filers more, but I got my NOA1 after about 10 days and filed in May. Could be a fluke because many things in the government depend primarily on who is processing your paperwork (I'm US military and that's usually the case when we try to track down late documents).

Yes, I would give them a call. The H1-B craze may be dying down a little as the USCIS said in a press release that everything will settle by June. Not sure if it's effecting April filers more, but I got my NOA1 after about 10 days and filed in May. Could be a fluke because many things in the government depend primarily on who is processing your paperwork (I'm US military and that's usually the case when we try to track down late documents).

I've added April and May to my General Stats page. You can see the slowdown in NOA1's for these months. This data only shows how many have already received the NOA1, so you may see waiting times increase in these tables as notices are issued. Hang in there! Hopefully they'll straighten out this mess.

We sent ours April 30th via express mail and it apparently got there May 1st. NO WORD. AYE! SOO frustrating and this is just the beginning of the process. I will call this week I think. I check everyday to see if the check was cashed! We just need a sign that it's proceeding!

to update my status, I got NOA1 today.

Hey all, I live about 5 miles from the CSC. There has been a lot of talk lately about immigration in general with all the protests and stuff. They did say on the news that the H1B visas are causing a backlog at the CSC. I think you all are just a victim of circumstance for when you filed. I got my NOA1 in 5 days from the time they received it. From that date it took almost 3 months to the day to get the NOA2. From what I hear (my neighbor works at CSC) they should start working on the K-1/3's again very soon if not already. You all should get them soon. The best way to tell is when your check is cashed. Your USCIS Case # will be on the back of the check. It will start with a WACxxxxxxxxxx. Once you get get the case number don't forget to register online so you can follow the progress of your case. They will even send you an email when it's approved and you get your NOA2. If you don't have that link, here it is: https://egov.immigration.gov/cris/jsps/selectusertype.jsp Just don't forget to register as an applicant. I know it doesn't help with the wait but it is what it is. I wish I had been able to file at VSC but that's what we get for living where the weather is nice year round. :-) Ken

We sent our application to California on April 24th and we have not received NOA1 yet, but the good news is that they cash the check May 25th and we are hoping to get news next week, so I guess they are over loaded.
