Don't worry too much about the evidence for bona fide marriage.

I can see the biggest problem you're facing right now is finance. Is your wife making enough money for both of you because you have lost your income, I don't think you can be the join sponsor with your wife.

Finance won't be a problem right now as I've had enough savings and she has a job. I really just want to get EAD ASAP so that I can start working again.

We had my wife'sinterview about a month ago. We submitted a good amount of evidence with our application and took updated to those to our interview. 

The officer had already reviewed our file with the evidence and asked us if we had any updated on what we submitted. We gave her a few updated and the interview went really smoothly. 

In the end of the interview she commented on how we made it really easy for her to make the approval decision because of all the evidence ( and organisation) we submitted with our application. 


I really don't see the point of NOT sending the evidence if you have it. Just my 2 cents. 

Yea I agree. I will send the lawyer whatever I have but it seems like he (me too) thinks more importantly we should file it ASAP for me to get an EAD soon. We can prepare the evidence for the interview.

Start the application asap. Waiting time for EAD is getting ridiculous and hard to predict. Even if you have a job offer, there's no guarantee it is approved with expedition request. Your employer may feel irritated keeping waiting for your EAD and retract the offer.

I've been waiting for my EAD since August. Submitted the expedition request, and they put it on hold because they decided to send me an RFIE (not RFE, RFIE) for the I485. There are many cases with job offers not being expedited.

So my advice is to proceed with the GC application asap. I wouldn't put too much hope into the H1B. It was abused for years, now everybody is paying the price.

You may have up to 2 years to collect evidence. Don't worry about it too much.

Yea thanks for the information. so my current firm promised me to take me back as soon as I have my EAD...no matter how long it takes...we are going to file my GC application on 11/26. My lawyer told me we may receive the EAD in late Feb/March...Are you in California? Can it be expedited with a job offer? Did you not have enough initial evidence?

I haven't received the RFIE in the mail so I don't know what it was about. I have just received the notification in the email and the iOS app saying that an RFIE has been sent to me.

Your lawyer can't guarantee anything. Many people got their EAD after 8 months. YMMV.

Usually people ask for expedition with a job offer and only after they have gotten fingerprinted. Just make a call to the USCIS and tell them you want to get it expedited due to severe financial loss.

You may  submit the expedition alongside with the AOS package, though it may cast doubt on the USCIS that you got married just because you want to keep your job.
