Hello, I have a similar problem too.

 

Today I got the email from NVC for case creation for my case but when I log into CEAC. There is no IV application fee to pay and my visa class is F24 even though my CSPA age is under 21 years old. As you can see from the picture I attached, my petition was pending for more than 2 and half years and when I subtract that time from my actual age at that time, my CSPA age is under 21 years old. My father is an LPR by the way.

 

I filled the asknvc form but in the website it is said that as of February 3, they are responding to inquiries they received at December 10 so there is nearly a 2 month gap between filing and getting a response. I already waited nearly 3 years and this is really bothering.

I will advice you to call NVC and ask for CSPA protection. Thats what I did and my sister got approved under CSPA.

I did and I made an inquiry through my congressman too. I hope this gets resolved soon because I already waited 3 years for NVC process to start and now I cannot even pay the fees and continue.

Hello, 

 

Try requesting the petition to get expedited. There grounds for getting it expedited. I know one is financial hardship and health issues. There’s more but forgot what it was. That’s what we did. I read that on this website too. Which is as matter of fact my mother( petitioner) was having a hard time to sleep due to anxiety. It was approved after 3 days. 1 week later we got an email for medical and interview appointment. email nvcexpedite@state.gov

Thank you so much. I sent an email to expedite too but I just don't get it how NVC doesn't make the calculations for CSPA age before creating the case.

They do...sometimes. They seem pretty inconsistent when it comes to CSPA. Their standard response is that it's up to the CO - technically true. I guess part of the problem also is that usually they won't know when the visa available date is when they do this (the current situation of F2A being current is unusual), so they usually can't do it definitively anyway.

I mean I already filled the asknvc form online. My congressman inquired about it too and I've sent an email to every possible NVC emails but my I-130 petition was approved 5 months ago and USCIS just decided on its own that since I have a sister whose petition was still pending, that they wouldnt send my approved case to NVC so that they could send both cases together. And now after waiting for 5 more months, I have this CSPA issue and still cannot continue the process. Next months it will be 3 years for me since we first filed the I-130. I just dont get it how they can just put me on F2B(F24) just because my actual age is over 21. The whole point of CSPA is to prevent this and they only apply it after case creation and after we request for CSPA review which delays the process again for god knows how long. Even my I-130 was approved under the F2A category and they don't look at the approval notice they get from USCIS and say "Oh his case was approved as F2A, maybe I should make attention to CSPA since he is older than 21 but approved as F2A".

This question might have been answered but in the previous thread but here is our timeline below: I filed separate  i-130 petition for my son and daughter 

 

Son

Date of Birth : August 16, 2000

Priority Date: September 18, 2017

Approval Date: December 23, 2019

Received Notice of Immigration Visa Case Creation from NVC:  Feb 5, 2020 

Paid AOS and DS-260 fee (Everything went smoothly with my son)

 

Daughter 

Date of Birth : Nov. 3, 1998

Priority Date: September 18, 2017

Approval Date: December 23, 2019

Received Notice of Immigration Visa Case Creation from NVC:  Feb 5, 2020 

Paid AOS fee Feb 5, 2020 

 

My question is when we received the NVC invoice number and case number for my daughter, the visa status shows F24 (F2B) and I was only able to pay the AOS Fee. When I checked under the applicant information, it is blank and my daughter's name is not showing as the principal applicant information thus not being able to pay the IV fee. After reading a whole lot of similar cases on VSJ, I believe that my daughters CSPA age will be under 21 so I decided to write an email to ASKNVC requesting for the CSPA on the 5th of February for my daughter. This morning, when I checked the ceac website just to see if there has been any update, I found out that I can no longer see both the Affidavit of support nor the applicant information. I checked my account to see if the AOS fee was reversed, it was not. 

 

Am i not able to see it because my daughter's case is under CSPA review or this is something else entirely? Is anyone else experiencing similar case? Any pointers or help will be greatly appreciated.

I had this exact issue literally 3 days ago when NVC sent us the visa creation emails. I have a sister too and we both got our emails the same day. I am covered by CSPA and she is 19 years old. We could pay for her fees but not mine. I filled the online asknvc form for CSPA review and called them along with contacting my congressman to speed up the process. They fixed it in less than 48 hours and I am now F22 and payed the fees.

This thread was started by me and "lives on" as others are giving great information on how to get NVC personnel to work for you regarding CSPA.  There has been nothing but success for those that have a CSPA protected at the "TIME" of their F2A (F22) petition being approved and visa priority date becoming "current".  You have one year after that "TIME" to file your DS-260 with NVC and ask NVC for CSPA protection.  Have patience and follow the steps others have done.  NVC is doing their job as the best they can so far given the stories here in this thread.  Your congressman is really not needed yet for any intervention or speeding up the process.  There is that one year window of CSPA protection before your filing of your DS-260 by law.  There is time for the system to work for you if you act as you are doing.
