Hello, last Tuesday I had my K1 interview, everything went fine, the only thing did I did not have were my court/police records.

I thought that they didn't need them since it happened more than 15 years ago,

They gave me an RFE, and I asked for my records, it shows 3 DUI's and 4 speeding tickets, they all happened between 2000 and 2004.

I have 2 questions,

1 Will my visa get denied because of this?

2 When will I get an answer from USCIS, I send them a sworn translation of my court records last Friday?

I hope that someone can give me some info, I feel devastated

Best regards from Holland

.

You got an rfe from the USCIS or a 221g from the consulate?

YMMV

I got a 221 I think from the consulate, it was a green piece of paper where they asked for more info about my police/court records.

The woman who interviewed me requested it

The USCIS is no longer involved, the consulate should respond within a few weeks after your response

YMMV

Really?

What are my chances to get approved?

I feel kinda lost, and the interview went really good. Until she told me that she couldn't give me the visa.

I.m desperate

Should merely be a delay.

12th, I know it was stupid to buy it, but it was a bargain.

Now I have to reschedule it but I don't know what date to choose?

As long as it takes. There is no fixed timeline for AP.

Usually you would be in the weeks to months range IMO, but every case is unique.

Time to put down the bottle...

Did you engage in any sort of rehabilitation or counseling? Did they ask about it during the medical or send you for a psych eval?

Did any of the DUis involve any other violations of laws, children, etc.?

No, nothing like that.

It all happened more than 15 years ago.

Ok, just checking. Some panel physicians will look at multiple DUIs as a pattern of behavior that may put yourself or others at risk, and refer the applicant to a psych evaluation to determine if that is the case or not. I guess the Netherlands doesn't regularly do this.

You can't choose a date until you have your visa in hand.

This means, not after you have been approved after you have your passport in hand with an error-free visa in it.

This is the only way to spare yourself more anxiety over your situation.

just wondering

A K1 with 221 returned to US /  is it actually reviewed ?

If the petition is returned to NVC then USCIS, no.

Although sometimes they send a request to the US to investigate something, which is different than a returned petition.
