QUESTION LIFTING CONDITIONS-

Hi guys I have a quick question - how long does it take from the day you file the papers until they issue you a permanent residence card ? I live in NY. I am having a baby at the same time my conditional residency expires so I would like to have a time frame to plan a trip back to my country.

I read all the time of cases where it can take up to 1 year. The NOA that you get when you file will extend your conditional green-card for 1 year.

I tried using the timelines to get an idea, but most dont seem to keep them updated for Lifting Conditions.

A whole year!!! OMG I am in tears. Vermont takes so long?

Oh another question and while my greencard is pending-the lifting conditions.. if I plan to travel do I have to apply for an advance parole? what a mess ....

No the NOA letter acts as an extension for the green card, just show the expired card along with the NOA to show the extension of status.

You will receive a notice of receipt for the form stating that "Your alien card is extended one year - employment and travel authorized". Keep the receipt with your green card. If by some chance you are not approved within a year you will want to make an InfoPass appointment to go to your Local Office to request an I-551 stamp in your passport. This does happen as it sometimes it takes over a year to be approved. After your NOA extension expires, this is your only evidence of legal status which you are required to have, by law. This happens occasionally, that a case takes over a year, but it's rare. Local Offices will not give an I-551 stamp is you have another type of evidence of status (ie, expired Green Card + extension letter).

But the NOA does not allow me to travel? what do i need to travel while my papers are processing?

The NOA1 extends your Greencard for 1 year.... so yes it does allow for foreign travel.... to take your expired Greencard and the NOA1 and that allows you to return to the US....

From what I have read, Vermont is taking about 6 to 7 months to process the I-751. For me, they have been very slow at cashing my check and getting the notice out. If you are leaving before your NOA1 arrives, then you should schedule an Infopass appointment to get an I-551 stamp. You don't want to be away when your biometric appointment is scheduled.
