marital status on paystubs..

Timeline

I just printed off a few recent paystubs from my work and I realized that there may be a problem. I am currently claiming single status, since I do not intend on claiming my husband on my tax returns until he gets here. Do you think I should write a note explaining that this is for tax purposes only or should I just not send them along and just send my tax return instead? :help:

12/28/06 - got married :)

02/05/07 - I-130 NOA1

02/21/07 - I-129 NOA1

04/09/07 - I-130 and I-129F approval email sent!!!!

04/26/07 - Packet 3 received

06/16/07 - Medical Examination

06/26/07 - Packet 3 SUBMITTED FINALLY!!!!

07/07/07 - Received pkt 4

07/22/07 - interview consular never bothered to show up for work.

07/29/07 - interview.

It is not unheard of to claim single for withholding even when you are married. Some people claim it that way to offset other income that doesn't have adequate tax withheld. I'm sure there are other reasons as well. There's no rule about what you claim for withholding other than it has to at least come close to covering what you owe at the end of the year. As long as you file returns as married after you were married there shouldn't be a problem.

No that is what I mean. When I filed I filed as head of household, as I am legally able to do if he is not here yet or has not been here for the majority of the year. So.......when 2007 came around I just kept my status as single since, being from Egypt, unless there is a major breakthrough in the way security checks are processed and Cairo operates, there is no way he'll be here much before Oct/Nov/Dec.

Are you saying you never told your employer to change your witholding status to married? As you said, this is a different issue than filing your tax returns as Married, Filing separately. I can't imagine it would have any impact at your interview, but it could have an impact with the IRS.

No. There is nothing to explain. Your W-4 payroll withholding status is not an indication of Marital status. Many married people claim Single and 0. No note is necessary.

July 18, 2007 - Biometrics completed

July 20, 2007 - Case transferred from MSC to CSC

July 31, 2007 - AOS Approved - 57 days - Without an Interview!

Aug 06, 2007 - Received Green Card in the mail today!

Jan 8, 2009 @ 8:18PM - Our son was born tonight !!

I-751 - Remove Conditions

July 11, 2009 - Certified Mail to VSC I-751 Package

July 14, 2009 - Check cleared bank

July 20, 2009 - NOA1 & 1 yr extension - Receipt date is July 14. Case# assigned

Sept 1, 2009 - Biometrics completed

Nov 25, 2009 - I-751 is approved. No Interview.

Are you saying you never told your employer to change your witholding status to married? As you said, this is a different issue than filing your tax returns as Married, Filing separately. I can't imagine it would have any impact at your interview, but it could have an impact with the IRS.

No it won't have any impact on the irs. My question was will it pose a problem when he shows them the stubs at the interview. I guess I'll just write a note stating why I claim as single in my w-4

I don't think they look that closely into things at the embassy in cairo.....you aren't doing anything illegal.....so, it shouldn't be a problem.

No, it won't pose any problem. Many married people claim as single 0. Do not worry about it at all.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
