Correct. But as you said, she makes no money (at least on paper), so as the saying goes “ you can’t get blood from a turnip”. Also especially it is her parents! Are they gonna more likely sue her, or you? I’ll give you one guess. 

 

Anyway, relax, on the other the side of this, they also have to know about this I-864 business to sue you. What are the chances that they know? Certainly they won’t learn it from their soon-to-be ex- son-in-law

If it's the IRS or almost any governmental agency is that they will go after whoever has the money to pay what is owed or who is making money. I know that for a fact.

You are involved in tax fraud with your wife working "under the table".  You need to discuss this with your divorce lawyer.  You are less likely to be required to support her when she has the demonstrated ability to earn incom

 

You have created a big problem for yourself and can be required to support all of them.  And as for them not knowing - the immigrant grapevine has long ago made people aware of it.  Why do you think you are the only sponsor with "income".

I received a summons for the divorce. She wants the judge to order the divorce. It doesn’t state that she wants any alimony or financial support. Besides seeking legal advice. Should I be worried the judge will grant the divorce and financial support?

Is there anything I can do to get out of my obligation for her parents since I’m the co-sponsor? Can I sue and tell USCIS that my wife is a fraud? Or is there no case here?

Well that would need to be discussed with your Lawer, I would assume very much depends on the extent of the evidence there is.

If you have concrete evidence supporting your claim, you can submit it.  Whether or not it will be investigated, is up to them.

They won't take into account your assumptions, feelings, or a verbal/written account of what you think is fraud.  They will want to see actual proof.  Do you have any proof?

My wife wants to divorce me.  She petitioned her mother and father to come to America. She is the sponsor also but i'm the co-sponsor as she didn't report enough income.  I signed the affidavit of support for her parents.  If we finalize the divorce, will a divorce decree help my situation or am I still on the hook to be responsible for her parents?  Has anyone gone through this situation?

 

If my wife is the sponsor, she would be responsible for her parents also?  I'm worried because her parents are older.  They may need health care in the future and if they can't pay the bill, they will go after me?  Will they go after my ex-wife also?

have they gotten the green card yet?

 

if not I believe you can send a letter to both the embassy and to the NVC pulling back your AOS as a joint sponsor.

Divorce does not impact an I-864 in any way.

If they haven't been issued the visa yet, you can request that they withdraw the I-864 if you no longer want to be a sponsor.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
